Amending and supplementing a number of articles of Circular No. 04/2015/TT-BCA dated January 05, 2015 of the Minister of Public Security specifying forms of papers related to entry, exit and residence of foreigners in Vietnam (amended and supplemented by Circular No. 57/2020/TT-BCA dated June 10, 2020 and Circular No. 22/2023/TT-BCA dated June 30, 2023) and Circular No. 31/2015/TT-BCA dated July 06, 2015 of the Minister of Public Security providing guidance on a number of contents on issuance of visas, temporary residence cards, entry and exit permits, and processing of permanent residence for foreigners in Vietnam (amended and supplemented by Circular No. 65/2022/TT-BCA dated December 30, 2022 and Circular No. 06/2025/TT-BCA dated January 16, 2025)

Sửa đổi, bổ sung một số điều của Thông tư số 04/2015/TT-BCA ngày 05 tháng 01 năm 2015 của Bộ trưởng Bộ Công an quy định mẫu giấy tờ liên quan đến việc nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam (được sửa đổi, bổ sung một số điều tại Thông tư số 57/2020/TT-BCA ngày 10 tháng 6 năm 2020 và Thông tư số 22/2023/TT-BCA ngày 30 tháng 6 năm 2023) và Thông tư số 31/2015/TT-BCA ngày 06 tháng 7 năm 2015 của Bộ trưởng Bộ Công an hướng dẫn một số nội dung về cấp thị thực, cấp thẻ tạm trú, cấp giấy phép xuất nhập cảnh, giải quyết thường trú cho người nước ngoài tại Việt Nam (được sửa đổi, bổ sung một số điều tại Thông tư số 65/2022/TT-BCA ngày 30 tháng 12 năm 2022 và Thông tư số 06/2025/TT-BCA ngày 16 tháng 01 năm 2025)

Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam No. 47/2014/QH13, as amended and supplemented by Law No. 51/2019/QH14, Law No. 23/2023/QH15, Law No. 103/2025/QH15, and Law No. 118/2025/QH15;

Căn cứ Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam số 47/2014/QH13 đã được sửa đổi, bổ sung một số điều theo Luật số 51/2019/QH14 , Luật số 23/2023/QH15 , Luật số 103/2025/QH15 và Luật số 118/2025/QH15 ;

The Minister of Public Security hereby promulgates the Circular amending and supplementing a number of articles of Circular No. 04/2015/TT-BCA dated January 05, 2015 of the Minister of Public Security specifying forms of papers related to entry, exit and residence of foreigners in Vietnam (amended and supplemented by Circular No. 57/2020/TT-BCA dated June 10, 2020 and Circular No. 22/2023/TT-BCA dated June 30, 2023) and Circular No. 31/2015/TT-BCA dated July 06, 2015 of the Minister of Public Security providing guidance on a number of contents on issuance of visas, temporary residence cards, entry and exit permits, and processing of permanent residence for foreigners in Vietnam (amended and supplemented by Circular No. 65/2022/TT-BCA dated December 30, 2022 and Circular No. 06/2025/TT-BCA dated January 16, 2025).

“1. Agencies, organizations, and individuals sponsoring foreigners to enter Vietnam pursuant to Clause 1 Article 16 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam (hereinafter referred to as the Law) shall directly submit documents requesting visa issuance to the Immigration Department or via public postal services or in an electronic environment, with respect to agencies and organizations satisfying the conditions specified in Clause 1 Article 16b of the Law and individuals satisfying the conditions specified in Point a Clause 1 Article 16b of the Law.”.

“1. Cơ quan, tổ chức, cá nhân bảo lãnh người nước ngoài vào Việt Nam theo khoản 1 Điều 16 của Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam (sau đây gọi tắt là Luật) trực tiếp gửi văn bản đề nghị cấp thị thực tại Cục Quản lý xuất nhập cảnh hoặc qua dịch vụ bưu chính công ích hoặc trên môi trường điện tử đối với cơ quan, tổ chức đáp ứng điều kiện quy định tại khoản 1 Điều 16b của Luật và cá nhân đáp ứng điều kiện quy định tại điểm a khoản 1 Điều 16b của Luật.”.

Article 7. Replacing and removing a number of phrases in a number of points, clauses, articles

Điều 7. Thay thế, bỏ một số cụm từ tại một số điểm, khoản, điều

1. Replace the phrase “05 years” with the phrase “10 years” in Clause 4 of Article 4.

1. Thay thế cụm từ “05 năm” bằng cụm từ “10 năm” tại khoản 4 Điều 4.

2. Remove the phrase “centrally affiliated” in the phrase “Police of provinces and centrally affiliated cities” in Clause 1 and Clause 3 of Article 4, Point b Clause 3 of Article 5, Clause 1 and Point b Clause 2 of Article 7.

2. Bỏ cụm từ “trực thuộc Trung ương” trong cụm từ “Công an tỉnh, thành phố trực thuộc Trung ương” tại khoản 1 và khoản 3 Điều 4, điểm b khoản 3 Điều 5, khoản 1 và điểm b khoản 2 Điều 7.

Article 8. Implementation provisions

Điều 8. Điều khoản thi hành

1. This Circular takes effect from July 01, 2026.

1. Thông tư này có hiệu lực từ ngày 01 tháng 7 năm 2026.

2. The Immigration Department shall be responsible for presiding over, and coordinating with Police units, localities, and other relevant units to organize the implementation, guidance, and inspection of the implementation of this Circular. Heads of agencies under the Ministry of Public Security and Directors of provincial-level Police shall be responsible for implementing this Circular.

2. Cục Quản lý xuất nhập cảnh có trách nhiệm chủ trì, phối hợp với Công an các đơn vị, địa phương và các đơn vị khác có liên quan tổ chức thực hiện và hướng dẫn, kiểm tra việc thực hiện Thông tư này. Thủ trưởng các cơ quan thuộc Bộ Công an, Giám đốc Công an cấp tỉnh chịu trách nhiệm thi hành Thông tư này.

In the course of implementation, if difficulties arise, Police units and localities shall report to the Ministry of Public Security (via the Immigration Department) for timely guidance.

Trong quá trình thực hiện nếu có vướng mắc, Công an các đơn vị, địa phương báo cáo về Bộ Công an (qua Cục Quản lý xuất nhập cảnh) để có hướng dẫn kịp thời.

Article 9. Transitional provisions

Điều 9. Điều khoản chuyển tiếp

1. Papers valid for entry, exit, and residence of foreigners issued prior to the effective date of this Circular shall continue to be used until their expiry or until the time of replacement as prescribed by law.

1. Giấy tờ có giá trị nhập cảnh, xuất cảnh, cư trú của người nước ngoài được cấp trước thời điểm Thông tư này có hiệu lực thi hành thì được tiếp tục sử dụng đến khi hết thời hạn hoặc đến thời hạn cấp đổi theo quy định của pháp luật.

2. For dossiers using paper forms under the provisions of Circular No. 04/2015/TT-BCA dated January 05, 2015 of the Minister of Public Security specifying forms of papers related to entry, exit and residence of foreigners in Vietnam (amended and supplemented by Circular No. 57/2020/TT-BCA dated June 10, 2020 and Circular No. 22/2023/TT-BCA dated June 30, 2023) that have been formulated or received by competent agencies prior to the effective date of this Circular, they shall continue to be processed and settled./.

2. Đối với các hồ sơ sử dụng mẫu giấy tờ theo quy định của Thông tư số 04/2015/TT-BCA ngày 05 tháng 01 năm 2015 của Bộ trưởng Bộ Công an quy định mẫu giấy tờ liên quan đến việc nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam (được sửa đổi, bổ sung một số điều tại Thông tư số 57/2020/TT-BCA ngày 10 tháng 6 năm 2020 và Thông tư số 22/2023/TT-BCA ngày 30 tháng 6 năm 2023) đã được cơ quan có thẩm quyền lập hoặc tiếp nhận trước thời điểm Thông tư này có hiệu lực thì tiếp tục được xử lý, giải quyết./.
