Sửa đổi, bổ sung một số điều của Nghị định số 69/2024/NĐ-CP ngày 25 tháng 6 năm 2024 của Chính phủ quy định về định danh và xác thực điện tử

At the proposal of the Minister of Public Security;

The Government promulgates the Decree amending and supplementing a number of articles of Decree No. 69/2024/NĐ-CP dated June 25, 2024 of the Government prescribing electronic identification and electronic authentication.

Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của Nghị định số 69/2024/NĐ-CP ngày 25 tháng 6 năm 2024 của Chính phủ quy định về định danh và xác thực điện tử.

Article 1. Supplementing Clause 12 and Clause 13 after Clause 11 of Article 3

Điều 1. Bổ sung khoản 12, khoản 13 vào sau khoản 11 của Điều 3

“12. Social security beneficiary account means identification information on the National Identification Application, enabling the electronic identity subject to integrate information on payment accounts, e-wallets, or mobile money accounts to receive subsidies, pensions, social security payments, and other lawful funding amounts.

“12. Tài khoản hưởng an sinh xã hội là thông tin định danh trên Ứng dụng định danh quốc gia, cho phép chủ thể danh tính điện tử tích hợp thông tin tài khoản thanh toán, ví điện tử, tài khoản tiền di động để tiếp nhận các khoản hỗ trợ, hưu trí, chi trả an sinh xã hội và các khoản kinh phí hợp pháp.

13. Electronic identification and electronic authentication system management and operation agency means an agency affiliated with the Ministry of Public Security assigned to manage and operate the electronic identification and electronic authentication system and the National Identification Application.”.

13. Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử là đơn vị trực thuộc Bộ Công an được giao quản lý, vận hành hệ thống định danh và xác thực điện tử, Ứng dụng định danh quốc gia.”.

Article 2. Amending and supplementing Clause 4 of Article 4

Điều 2. Sửa đổi, bổ sung khoản 4 của Điều 4

“4. Agencies, organizations, and individuals, when receiving and processing administrative procedures, public services, civil transactions, and other activities, shall exploit and use electronic identities, information, and papers integrated into the National Identification Application, and must not request individuals and organizations to submit or present originals or copies of papers and documents already integrated into the National Identification Application. The exploitation and use of electronic identities must ensure the confidentiality of electronic identity account information and comply with the provisions of law on personal data protection, in accordance with regulations ensuring the safety and confidentiality of private life, personal secrets, and family secrets.

“4. Cơ quan, tổ chức, cá nhân khi tiếp nhận, giải quyết thủ tục hành chính, dịch vụ công, giao dịch dân sự và các hoạt động khác thực hiện khai thác và sử dụng danh tính điện tử, thông tin, giấy tờ đã tích hợp trên Ứng dụng định danh quốc gia, không được yêu cầu cá nhân, tổ chức nộp, xuất trình bản chính hoặc bản sao các giấy tờ, tài liệu đã được tích hợp trên Ứng dụng định danh quốc gia. Việc khai thác và sử dụng danh tính điện tử phải bảo mật thông tin tài khoản định danh điện tử và tuân thủ quy định của pháp luật về bảo vệ dữ liệu cá nhân, phù hợp quy định bảo đảm an toàn và bí mật đời sống riêng tư, bí mật cá nhân, bí mật gia đình.

Agencies, organizations, and individuals performing online administrative procedures and public services via the National Identification Application shall be granted fee and charge exemptions or reductions. The exemption or reduction of fees and charges shall comply with the law on fees and charges.”.

Cơ quan, tổ chức, cá nhân khi thực hiện thủ tục hành chính, dịch vụ công trực tuyến qua ứng dụng định danh quốc gia được miễn, giảm phí, lệ phí. Việc miễn, giảm phí, lệ phí được thực hiện theo quy định pháp luật về phí và lệ phí.”.

Article 3. Amending and supplementing Article 7

Điều 3. Sửa đổi, bổ sung Điều 7

“Article 7. Classification and subjects eligible for issuance of electronic identity accounts

“Điều 7. Phân loại, đối tượng được cấp tài khoản định danh điện tử

1. Vietnamese citizens aged full 06 years or older who have been issued valid citizen identity cards or identity cards shall be granted level 01 electronic identity accounts and level 02 electronic identity accounts upon request. Vietnamese citizens under 06 years of age who have been issued identity cards shall be granted level 01 electronic identity accounts upon request.

1. Công dân Việt Nam từ đủ 06 tuổi trở lên đã được cấp thẻ căn cước công dân hoặc thẻ căn cước còn thời hạn sử dụng được cấp tài khoản định danh điện tử mức độ 01, tài khoản định danh điện tử mức độ 02 khi có nhu cầu. Công dân Việt Nam dưới 06 tuổi đã được cấp thẻ căn cước được cấp tài khoản định danh điện tử mức độ 01 khi có nhu cầu.

2. Foreigners entering Vietnam lawfully or residing lawfully in Vietnam shall be granted electronic identity accounts without level classification upon request.

2. Người nước ngoài nhập cảnh hợp pháp vào Việt Nam hoặc cư trú hợp pháp tại Việt Nam được cấp tài khoản định danh điện tử không phân biệt theo mức độ khi có nhu cầu.

3. Agencies and organizations established or registered to operate in Vietnam shall be granted electronic identity accounts without level classification upon request.”.

3. Cơ quan, tổ chức được thành lập hoặc đăng ký hoạt động tại Việt Nam được cấp tài khoản định danh điện tử không phân biệt theo mức độ khi có nhu cầu.”.

Article 4. Amending and supplementing Article 8

Điều 4. Sửa đổi, bổ sung Điều 8

“Article 8. Updating, sharing, and exploiting information and papers in the electronic identification and electronic authentication system as prescribed

“Điều 8. Cập nhật, chia sẻ, khai thác thông tin, giấy tờ trong hệ thống định danh và xác thực điện tử theo quy định

1. Papers not classified as state secrets issued by competent agencies and organizations to agencies, organizations, and individuals shall be automatically synchronized and updated into the electronic identification and electronic authentication system when such agencies and organizations possess databases connected with the electronic identification and electronic authentication system.

1. Các giấy tờ không thuộc bí mật nhà nước do cơ quan, tổ chức có thẩm quyền cấp cho cơ quan, tổ chức, cá nhân được tự động đồng bộ, cập nhật vào hệ thống định danh và xác thực điện tử khi cơ quan, tổ chức đó có cơ sở dữ liệu đã kết nối với hệ thống định danh và xác thực điện tử.

When there is any change in information or papers on the National Identification Application, the competent paper-issuing agency or organization must immediately update the information and papers. Where objective reasons prevent immediate implementation at the time of change occurrence, the updating time on the National Identification Application shall not exceed 24 hours from the time the update data arises, and not exceed 05 minutes in cases where citizens request direct updates on the National Identification Application.

Khi thông tin, giấy tờ trên ứng dụng định danh quốc gia có sự thay đổi thì cơ quan, tổ chức có thẩm quyền cấp giấy tờ phải thực hiện cập nhật ngay thông tin, giấy tờ. Trường hợp khách quan chưa thể thực hiện tại thời điểm phát sinh thay đổi thì thời gian cập nhật trên ứng dụng định danh quốc gia không quá 24 giờ kể từ thời điểm phát sinh dữ liệu cập nhật và không quá 05 phút trong trường hợp công dân có yêu cầu cập nhật trực tiếp trên ứng dụng định danh quốc gia.

2. The integration of information and papers in cases where competent paper-issuing agencies and organizations have not possessed databases shall be carried out as follows:

2. Việc tích hợp thông tin, giấy tờ trong trường hợp cơ quan, tổ chức có thẩm quyền cấp giấy tờ chưa có cơ sở dữ liệu được thực hiện như sau:

a) The electronic identity subject submits an integration request for information and papers to the electronic identification and electronic authentication system via the National Identification Application;

a) Chủ thể danh tính điện tử gửi yêu cầu tích hợp thông tin, giấy tờ đến hệ thống định danh và xác thực điện tử thông qua ứng dụng định danh quốc gia;

b) Within 05 working days from the date the electronic identification and electronic authentication system receives the request, the competent paper-issuing agency or organization shall access the electronic identification and electronic authentication system using the electronic identity account of such agency or organization to receive, process, and approve the request for integration of information and papers of the electronic identity subject in accordance with guidelines of the Ministry of Public Security;

b) Trong thời gian 05 ngày làm việc kể từ ngày hệ thống định danh và xác thực điện tử nhận được yêu cầu, cơ quan, tổ chức có thẩm quyền cấp giấy tờ thực hiện truy cập hệ thống định danh và xác thực điện tử bằng tài khoản định danh điện tử của cơ quan, tổ chức đó để tiếp nhận, xử lý, phê duyệt yêu cầu tích hợp thông tin, giấy tờ của chủ thể danh tính điện tử theo hướng dẫn của Bộ Công an;

c) The competent paper-issuing agency or organization shall update the information and papers integrated into the National Identification Application concurrently with approving the adjustment of such information and papers.

c) Cơ quan, tổ chức có thẩm quyền cấp giấy tờ thực hiện cập nhật thông tin, giấy tờ đã tích hợp trên ứng dụng định danh quốc gia đồng thời với việc phê duyệt điều chỉnh thông tin, giấy tờ đó.

3. The electronic identification and electronic authentication system management and operation agency shall integrate papers onto the National Identification Application at the request of electronic identity subjects to serve sharing, exploitation, and use in the electronic environment.

3. Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử tích hợp giấy tờ lên ứng dụng định danh quốc gia theo yêu cầu của chủ thể danh tính điện tử để phục vụ việc chia sẻ, khai thác, sử dụng trên môi trường điện tử.

4. State agencies, political organizations, and socio-political organizations are entitled to exploit information and papers in the electronic identification and electronic authentication system consistent with the functions and duties of such agencies and organizations.

4. Cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội được khai thác thông tin, giấy tờ trong hệ thống định danh và xác thực điện tử phù hợp với chức năng, nhiệm vụ của cơ quan, tổ chức đó.

5. Agencies, organizations, and individuals are entitled to exploit their own information and papers in the electronic identification and electronic authentication system.

5. Cơ quan, tổ chức, cá nhân được khai thác thông tin, giấy tờ của mình trong hệ thống định danh và xác thực điện tử.

6. Agencies, organizations, and individuals not specified in Clause 4 and Clause 5 of this Article, when exploiting information and papers of other organizations and individuals in the electronic identification and electronic authentication system via the National Identification Application, must obtain the consent of the subject of the exploited information and papers. In cases of exploiting information and papers of persons lacking civil act capacity, persons having difficulty in understanding and controlling their acts under the Civil Code, persons under 14 years of age, persons declared missing, or deceased persons, consent must be obtained from one of the legal representatives or heirs in accordance with the law.”.

6. Cơ quan, tổ chức, cá nhân không thuộc quy định tại khoản 4 và khoản 5 Điều này khi khai thác thông tin, giấy tờ của tổ chức, cá nhân khác trong hệ thống định danh và xác thực điện tử qua ứng dụng định danh quốc gia phải được sự đồng ý của chủ thể thông tin, giấy tờ được khai thác. Trường hợp khai thác thông tin, giấy tờ của người bị mất năng lực hành vi dân sự, người có khó khăn trong nhận thức, làm chủ hành vi theo quy định của Bộ luật Dân sự, người dưới 14 tuổi, người bị tuyên bố mất tích, người đã chết phải được sự đồng ý của một trong những người đại diện hợp pháp, người thừa kế theo quy định pháp luật.”.

Article 5. Amending and supplementing Article 9

Điều 5. Sửa đổi, bổ sung Điều 9

“Article 9. Use of electronic identity accounts and other electronic transaction accounts created by agencies, organizations, and individuals

“Điều 9. Sử dụng tài khoản định danh điện tử, tài khoản giao dịch điện tử khác do cơ quan, tổ chức, cá nhân tạo lập

1. Level 01 electronic identity accounts of Vietnamese citizens shall be used to access, exploit, and use electronic identity information and certain features, utilities, and applications of the electronic identification and electronic authentication system and information systems that have been connected and shared in accordance with the law.

1. Tài khoản định danh điện tử mức độ 01 của công dân Việt Nam được sử dụng để truy cập, khai thác, sử dụng thông tin về danh tính điện tử và một số tính năng, tiện ích, ứng dụng của hệ thống định danh và xác thực điện tử, hệ thống thông tin đã được kết nối, chia sẻ theo quy định của pháp luật.

2. Level 02 electronic identity accounts of Vietnamese citizens shall be used to access, exploit, and use electronic identification cards, other information besides the information integrated into electronic identification cards shared, integrated, and updated from national databases and specialized databases, and all features, utilities, and applications of the electronic identification and electronic authentication system and information systems that have been connected and shared in accordance with the law.

2. Tài khoản định danh điện tử mức độ 02 của công dân Việt Nam được sử dụng để truy cập, khai thác, sử dụng căn cước điện tử, thông tin khác ngoài thông tin đã tích hợp vào căn cước điện tử được chia sẻ, tích hợp, cập nhật từ cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành và toàn bộ tính năng, tiện ích, ứng dụng của hệ thống định danh và xác thực điện tử, hệ thống thông tin đã được kết nối, chia sẻ theo quy định của pháp luật.

3. Electronic identity accounts of foreigners and electronic identity accounts of agencies and organizations shall be used to access, exploit, and use electronic identity information and other information shared, integrated, and updated from national databases and specialized databases, and all features, utilities, and applications of the electronic identification and electronic authentication system and information systems that have been connected and shared in accordance with the law.

3. Tài khoản định danh điện tử của người nước ngoài, tài khoản định danh điện tử của cơ quan, tổ chức được sử dụng để truy cập, khai thác, sử dụng thông tin danh tính điện tử và thông tin khác được chia sẻ, tích hợp, cập nhật từ cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành và toàn bộ tính năng, tiện ích, ứng dụng của hệ thống định danh và xác thực điện tử, hệ thống thông tin đã được kết nối, chia sẻ theo quy định của pháp luật.

4. Electronic identity subjects shall use electronic identity accounts to log in, authenticate, integrate, store, manage, and share information and papers, and use services and utilities on the National Identification Application, the electronic identification web portal, or utilities on other applications and software of agencies, organizations, and individuals that have been connected with the electronic identification and electronic authentication system.

4. Chủ thể danh tính điện tử sử dụng tài khoản định danh điện tử để đăng nhập, xác thực, tích hợp, lưu trữ, quản lý, chia sẻ thông tin, giấy tờ và sử dụng dịch vụ, tiện ích trên ứng dụng định danh quốc gia, trang thông tin định danh điện tử hoặc các tiện ích trên ứng dụng, phần mềm khác của cơ quan, tổ chức, cá nhân đã được kết nối với hệ thống định danh và xác thực điện tử.

5. Electronic identity accounts shall be used to perform and receive results of administrative procedures and public services in the electronic environment and other activities according to the needs of electronic identity subjects. The use of electronic identity accounts to log in and use electronic transactions serving credit, telecommunications, transport, e-commerce, import-export, and other essential activities is encouraged.

5. Tài khoản định danh điện tử được sử dụng để thực hiện, nhận kết quả thủ tục hành chính, dịch vụ công trên môi trường điện tử và các hoạt động khác theo nhu cầu của chủ thể danh tính điện tử. Khuyến khích sử dụng tài khoản định danh điện tử đăng nhập sử dụng các giao dịch điện tử phục vụ các hoạt động tín dụng, viễn thông, giao thông, thương mại điện tử, xuất nhập khẩu và các hoạt động thiết yếu khác.

6. The use of electronic identity information and information and papers integrated into electronic identification cards, electronic identity accounts, and the electronic identification and electronic authentication system shall have validity equivalent to the provision of information or presentation of papers in the execution of administrative procedures, public services, and other transactions and activities.

6. Việc sử dụng thông tin về danh tính điện tử và thông tin, giấy tờ tích hợp trên căn cước điện tử, tài khoản định danh điện tử, hệ thống định danh và xác thực điện tử có giá trị tương đương với việc cung cấp thông tin hoặc xuất trình giấy tờ trong thực hiện thủ tục hành chính, dịch vụ công, các giao dịch và hoạt động khác.

7. Agencies, organizations, and individuals may establish electronic transaction accounts in accordance with the law on electronic transactions to serve their transactions and activities, and shall be responsible for authenticating and ensuring the accuracy of accounts created by themselves, and deciding the levels and usage validity of each account level. Information used to create an electronic transaction account must be provided by the account subject with consent granted to the agency, organization, or individual to use it for account creation.

7. Cơ quan, tổ chức, cá nhân được tạo lập tài khoản giao dịch điện tử theo quy định của pháp luật về giao dịch điện tử để phục vụ giao dịch, hoạt động của mình và chịu trách nhiệm xác thực, bảo đảm tính chính xác của tài khoản do mình tạo lập, quyết định mức độ và giá trị sử dụng của từng mức độ tài khoản. Thông tin để tạo lập tài khoản giao dịch điện tử phải do chủ thể của tài khoản cung cấp và đồng ý cho cơ quan, tổ chức, cá nhân sử dụng để tạo lập tài khoản.

8. Electronic identity subjects shall use the National Identification Application to prepare and submit applications for resolution of administrative procedures. Applications shall be transferred from the National Identification Application to the National Public Service Portal; the results of the resolution of administrative procedures of such applications shall be transferred from the National Public Service Portal to the National Identification Application for notification to agencies, organizations, and individuals as prescribed.

8. Chủ thể danh tính điện tử sử dụng ứng dụng định danh quốc gia để tạo lập, gửi hồ sơ yêu cầu giải quyết thủ tục hành chính. Hồ sơ được chuyển từ ứng dụng định danh quốc gia đến cổng dịch vụ công quốc gia; kết quả giải quyết thủ tục hành chính của hồ sơ đó được chuyển từ cổng dịch vụ công quốc gia đến ứng dụng định danh quốc gia để thông báo cho cơ quan, tổ chức, cá nhân theo quy định.

9. State agencies, political organizations, and socio-political organizations shall carry out payment of subsidies, pensions, social security payments, and other lawful funding amounts from the state budget via bank transfer to social security beneficiary accounts on the National Identification Application; except where the beneficiaries have not created social security beneficiary accounts and have not provided written authorizations for receipt, in which case social security payments shall be made via other methods as prescribed.

9. Cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội thực hiện việc chi trả các khoản hỗ trợ, hưu trí, chi trả an sinh xã hội và các khoản kinh phí hợp pháp khác từ ngân sách nhà nước qua hình thức chuyển khoản đến tài khoản hưởng an sinh xã hội trên ứng dụng định danh quốc gia; trừ trường hợp đối tượng thụ hưởng chưa tạo lập tài khoản hưởng an sinh xã hội và chưa có văn bản ủy quyền tiếp nhận thì thực hiện các khoản chi trả an sinh xã hội theo hình thức khác theo quy định.

Agencies, organizations, and individuals are encouraged to choose to pay charitable aids or other funding amounts not sourced from the state budget via social security beneficiary accounts on the National Identification Application.

Khuyến khích cơ quan, tổ chức, cá nhân lựa chọn chi trả các khoản hỗ trợ từ thiện hoặc kinh phí khác không từ ngân sách nhà nước qua tài khoản hưởng an sinh xã hội trên ứng dụng định danh quốc gia.

Each agency, organization, or individual shall only integrate one payment account, e-wallet, or mobile money account held under their own name matching the electronic identity account information to receive social security benefits.

Mỗi cơ quan, tổ chức, cá nhân chỉ được tích hợp một tài khoản thanh toán hoặc ví điện tử hoặc tài khoản tiền di động chính chủ theo thông tin trùng khớp với tài khoản định danh điện tử để hưởng an sinh xã hội.

10. Agencies, organizations, and foreigners possessing electronic identity accounts, and Vietnamese citizens possessing level 02 electronic identity accounts, shall be provided with a communication channel on the National Identification Application. State agencies, political organizations, and socio-political organizations shall send notices concerning agencies, organizations, and individuals via the communication channel on the National Identification Application; and receive feedback and recommendations from agencies, organizations, and individuals on matters related to the use of electronic identity accounts and electronic transaction accounts.

10. Cơ quan, tổ chức, người nước ngoài có tài khoản định danh điện tử, công dân Việt Nam có tài khoản định danh điện tử mức độ 02 được cung cấp một kênh giao tiếp trên ứng dụng định danh quốc gia. Cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội gửi thông báo liên quan đến cơ quan, tổ chức, cá nhân qua kênh giao tiếp trên ứng dụng định danh quốc gia; tiếp nhận ý kiến phản ánh, kiến nghị của cơ quan, tổ chức, cá nhân về các vấn đề có liên quan đến việc sử dụng tài khoản định danh điện tử, tài khoản giao dịch điện tử.

11. Where Identity cards, Citizen identity cards, or information and papers integrated into electronic identity accounts expire or lose validity, the electronic identification and electronic authentication system shall notify citizens to proactively carry out the replacement of Identity cards or the re-issuance or extension of papers in accordance with the law.

11. Trường hợp thẻ Căn cước, thẻ Căn cước công dân, thông tin, giấy tờ được tích hợp vào tài khoản định danh điện tử hết hạn, hết hiệu lực thì hệ thống định danh và xác thực điện tử thông báo để công dân chủ động thực hiện cấp đổi thẻ Căn cước hoặc cấp đổi, gia hạn giấy tờ theo quy định pháp luật.

The electronic identification and electronic authentication system shall automatically restore electronic Identification cards and information and papers integrated into electronic identity accounts that have expired or lost validity immediately after Identity cards, information, or papers are successfully replaced or extended.”.

Hệ thống định danh và xác thực điện tử tự động khôi phục Căn cước điện tử và các thông tin, giấy tờ đã tích hợp vào tài khoản định danh điện tử đã hết hạn, hết hiệu lực ngay sau khi thẻ Căn cước, thông tin, giấy tờ được cấp đổi, gia hạn thành công.”.

Article 6. Amending and supplementing Article 11

Điều 6. Sửa đổi, bổ sung Điều 11

“Article 11. Order and procedures for issuance of electronic identity accounts to foreigners

“Điều 11. Trình tự, thủ tục cấp tài khoản định danh điện tử đối với người nước ngoài

1. A foreigner shall visit the immigration authority of the provincial-level Police Department, present a passport or international travel document, and carry out procedures for issuance of an electronic identity account.

1. Người nước ngoài đến cơ quan quản lý xuất nhập cảnh Công an cấp tỉnh xuất trình hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế và làm thủ tục cấp tài khoản định danh điện tử.

2. The foreigner shall provide complete and accurate information in the Request Form for issuance of an electronic identity account according to Form TK01 issued with this Decree; in which clearly providing the official mobile phone subscriber number registered under his/her name, email address of the foreigner (if any), and other information requested for integration into the National Identification Application to the receiving officer.

2. Người nước ngoài cung cấp đầy đủ, chính xác thông tin trên Phiếu đề nghị cấp tài khoản định danh điện tử theo Mẫu TKO1 ban hành kèm theo Nghị định này; trong đó cung cấp rõ số thuê bao di động chính chủ, địa chỉ thư điện tử của người nước ngoài (nếu có) và thông tin khác đề nghị tích hợp vào ứng dụng định danh quốc gia cho cán bộ tiếp nhận.

3. The receiving officer shall input the information provided by the foreigner into the electronic identification and electronic authentication system; capture the facial image and take fingerprints of the visiting foreigner to perform authentication with the National Database on Immigration; instruct the foreigner to use a digital device to download and install the National Identification Application, and declare information according to instructions on the National Identification Application.

3. Cán bộ tiếp nhận nhập thông tin người nước ngoài cung cấp vào hệ thống định danh và xác thực điện tử; thu nhận ảnh khuôn mặt, thu nhận vân tay của người nước ngoài đến để thực hiện xác thực với Cơ sở dữ liệu quốc gia về xuất nhập cảnh; hướng dẫn người nước ngoài sử dụng thiết bị số tải và cài đặt ứng dụng định danh quốc gia, kê khai các thông tin theo hướng dẫn trên ứng dụng định danh quốc gia.

4. The immigration authority shall send the request for issuance of an electronic identity account to the electronic identification and electronic authentication system management and operation agency.

4. Cơ quan quản lý xuất nhập cảnh gửi yêu cầu cấp tài khoản định danh điện tử tới Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử.

5. The electronic identification and electronic authentication system management and operation agency shall notify account registration results via the National Identification Application, the official mobile phone subscriber number registered under his/her name, or email address.

5. Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử thông báo kết quả đăng ký tài khoản qua ứng dụng định danh quốc gia hoặc số thuê bao di động chính chủ hoặc địa chỉ thư điện tử.

6. Foreigners who are under 14 years of age, under guardianship, or represented shall, together with their representatives or guardians, visit the immigration authority of the provincial-level Police Department to carry out procedures for issuance of electronic identity accounts.

6. Người nước ngoài là người dưới 14 tuổi, người được giám hộ, người được đại diện cùng người đại diện hoặc người giám hộ của mình đến cơ quan quản lý xuất nhập cảnh Công an cấp tỉnh để làm thủ tục cấp tài khoản định danh điện tử.

The representative or guardian shall use their own registered official mobile phone subscriber number to declare and register the issuance of electronic identity accounts for foreigners under 14 years of age, persons under guardianship, or represented persons.”.

Người đại diện, người giám hộ sử dụng số thuê bao di động chính chủ của mình để kê khai, đăng ký cấp tài khoản định danh điện tử cho người nước ngoài dưới 14 tuổi, người được giám hộ, người được đại diện.”.

Article 7. Amending and supplementing Clause 3 and Point b Clause 4 of Article 13

Điều 7. Sửa đổi, bổ sung khoản 3 và điểm b khoản 4 của Điều 13

b) Not exceeding 05 working days in cases of issuing electronic identity accounts where facial images and fingerprints are not yet available in the National Database on Immigration.”.

b) Không quá 05 ngày làm việc với trường hợp cấp tài khoản định danh điện tử nhưng chưa có thông tin về ảnh khuôn mặt, vân tay trong Cơ sở dữ liệu quốc gia về xuất nhập cảnh.”.

2. Amending and supplementing Point b Clause 4 as follows:

a) The electronic identification and electronic authentication system automatically locks or unlocks a citizen's electronic identity account when the citizen's electronic identification card is locked or unlocked;

a) Hệ thống định danh và xác thực điện tử tự động khóa, mở khóa tài khoản định danh điện tử của công dân khi căn cước điện tử của công dân bị khóa, mở khóa;

b) The electronic identification and electronic authentication system automatically locks a citizen's electronic identity account when the mobile phone subscriber number used by the citizen to register the electronic identity account has changed and is not registered under his/her name.”.

b) Hệ thống định danh và xác thực điện tử tự động khóa tài khoản định danh điện tử của công dân khi số thuê bao di động công dân sử dụng để đăng ký tài khoản định danh điện tử đã thay đổi và không chính chủ.”.

“b) The electronic identification and electronic authentication system automatically records, verifies, authenticates, and locks an electronic identity account in cases where an organization requests the locking of its electronic identity account; or such organization violates the agreement on the use of the National Identification Application; or is dissolved, bankrupted, suspended, or terminated from operation under the law; or the person whose name is registered under the account (the legal representative, head of the agency or organization, or authorized person) is subject to an enforcement decision by a competent authority.

“b) Hệ thống định danh và xác thực điện tử tự động ghi nhận, kiểm tra, xác thực và khóa tài khoản định danh điện tử trong trường hợp tổ chức yêu cầu khóa tài khoản định danh điện tử của mình; hoặc tổ chức đó vi phạm thỏa thuận sử dụng ứng dụng định danh quốc gia; hoặc bị giải thể, phá sản, tạm dừng, chấm dứt hoạt động theo quy định của pháp luật; hoặc người đứng tên đăng ký tài khoản (người đại diện theo pháp luật hoặc người đứng đầu cơ quan, tổ chức, hoặc người được ủy quyền) có quyết định thi hành án của cơ quan có thẩm quyền.

Where the electronic identity account of an organization is locked because the registered account holder of the organization is subject to an enforcement decision by a competent authority, this account shall be unlocked when such agency or organization changes the registered account holder.

Trường hợp tài khoản định danh điện tử của tổ chức bị khóa do người đứng tên đăng ký tài khoản của tổ chức có quyết định thi hành án của cơ quan có thẩm quyền, tài khoản này được mở khóa khi cơ quan, tổ chức đó thực hiện thay đổi người đứng tên đăng ký tài khoản.

The electronic identification and electronic authentication system automatically records such through the declaration of the organization on the National Identification Application or through the updating and sharing of information specified in Article 8 of this Decree.”.

Hệ thống định danh và xác thực điện tử tự động ghi nhận thông qua việc khai báo của tổ chức trên ứng dụng định danh quốc gia hoặc qua việc cập nhật, chia sẻ thông tin quy định tại Điều 8 Nghị định này.”.

Article 9. Amending and supplementing Article 16

“Article 16. Competence to issue, lock, and unlock electronic identity accounts for Vietnamese citizens, foreigners, agencies, and organizations

“Điều 16. Thẩm quyền cấp, khóa, mở khóa tài khoản định danh điện tử đối với công dân Việt Nam, người nước ngoài, cơ quan, tổ chức

The Head of the electronic identification and electronic authentication system management and operation agency has the competence to issue, lock, and unlock electronic identity accounts for agencies, organizations, Vietnamese citizens, and foreigners residing in the territory of Vietnam.”.

Thủ trưởng Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử có thẩm quyền cấp, khóa, mở khóa tài khoản định danh điện tử đối với cơ quan, tổ chức, công dân Việt Nam, người nước ngoài đang cư trú trên lãnh thổ Việt Nam.”.

Article 10. Amending and supplementing Article 18

Điều 10. Sửa đổi, bổ sung Điều 18

“Article 18. Conditions and procedures for connecting with the electronic identification and electronic authentication system

“Điều 18. Điều kiện, trình tự kết nối với hệ thống định danh và xác thực điện tử

1. State agencies, political organizations, socio-political organizations, public service provider organizations, and organizations assigned to perform tasks serving state management, payment of subsidies, pensions, social security payments, and other lawful funding amounts are entitled to connect information systems under their management with the electronic identification and electronic authentication system upon meeting the information system cybersecurity assurance plan of at least level 3 in accordance with the law on cybersecurity.

1. Cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức cung cấp dịch vụ công, tổ chức được giao thực hiện các nhiệm vụ phục vụ quản lý nhà nước, chi trả các khoản hỗ trợ, hưu trí, chi trả an sinh xã hội và các khoản kinh phí hợp pháp khác được kết nối hệ thống thông tin do mình quản lý với hệ thống định danh và xác thực điện tử khi đáp ứng phương án bảo đảm an ninh mạng hệ thống thông tin tối thiểu cấp độ 3 theo quy định của pháp luật về an ninh mạng.

2. Agencies and organizations wishing to connect as prescribed in Clause 1 of this Article shall send a written request clearly stating the scope and purpose of the connection together with documents proving that the information system under management meets the information system cybersecurity assurance plan of at least level 3 to the electronic identification and electronic authentication system management and operation agency.

2. Cơ quan, tổ chức có nhu cầu kết nối theo quy định tại khoản 1 Điều này gửi văn bản đề nghị nêu rõ phạm vi và mục đích thực hiện kết nối kèm tài liệu chứng minh hệ thống thông tin đang quản lý đáp ứng phương án bảo đảm an ninh mạng hệ thống thông tin tối thiểu cấp độ 3 đến Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử.

3. The electronic identification and electronic authentication system management and operation agency shall be responsible for coordinating with specialized cybersecurity protection forces under the Ministry of Public Security and relevant agencies, organizations, and individuals to conduct security and safety inspections of the information system of the requesting unit, except for military information systems and cipher information systems under the Government Cipher Committee; and reaching written agreement with the agency or organization managing the database or information system to be connected.

3. Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử có trách nhiệm phối hợp với lực lượng chuyên trách bảo vệ an ninh mạng thuộc Bộ Công an, cơ quan, tổ chức, cá nhân có liên quan thực hiện kiểm tra an ninh, an toàn hệ thống thông tin của đơn vị đề nghị kết nối, trừ hệ thống thông tin quân sự và hệ thống thông tin cơ yếu thuộc Ban Cơ yếu Chính phủ; thống nhất với cơ quan, tổ chức chủ quản cơ sở dữ liệu, hệ thống thông tin cần kết nối bằng văn bản.

4. Within a time limit not exceeding 05 working days from the date of completing the inspection, the electronic identification and electronic authentication system management and operation agency shall carry out the connection of the electronic identification and electronic authentication system with the database and information system of the requesting agency or organization.

4. Trong thời hạn không quá 05 ngày làm việc, kể từ ngày hoàn thành việc kiểm tra, Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử tiến hành việc kết nối hệ thống định danh và xác thực điện tử với cơ sở dữ liệu, hệ thống thông tin của cơ quan, tổ chức đề nghị kết nối.

5. Agencies and organizations wishing to use electronic authentication services shall connect with the electronic identification and electronic authentication system through electronic authentication service providers according to plans and procedures approved by the electronic identification and electronic authentication system management and operation agency.

5. Cơ quan, tổ chức có nhu cầu sử dụng dịch vụ xác thực điện tử thực hiện kết nối với hệ thống định danh và xác thực điện tử thông qua tổ chức cung cấp dịch vụ xác thực điện tử theo phương án, quy trình đã được Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử phê duyệt.

6. Agencies and organizations connected to, exploiting, and using information and papers in the electronic identification and electronic authentication system shall be responsible for storing and providing exploitation and usage history of information and papers to the electronic identification and electronic authentication system management and operation agency to display on the National Identification Application for the knowledge of electronic identity subjects. Information on exploitation and usage history includes information, papers, purpose, frequency, time, and exploiting and using subjects.

6. Cơ quan, tổ chức được kết nối, khai thác, sử dụng thông tin, giấy tờ trong hệ thống định danh và xác thực điện tử có trách nhiệm lưu trữ, cung cấp lịch sử khai thác, sử dụng thông tin, giấy tờ cho Cơ quan quản lý, vận hành hệ thống định danh và xác thực điện tử hiển thị trên ứng dụng định danh quốc gia để chủ thể danh tính điện tử biết. Thông tin lịch sử khai thác, sử dụng gồm các thông tin, giấy tờ, mục đích, số lượt, thời gian, đối tượng khai thác, sử dụng.

7. Authentication, exploitation, and use of information and papers integrated from the electronic identification and electronic authentication system must not be shared or provided to other agencies, organizations, or individuals. Except where requested to be shared by the data subject or otherwise provided by law.”.

7. Việc xác thực, khai thác, sử dụng thông tin, giấy tờ tích hợp từ hệ thống định danh và xác thực điện tử không được chia sẻ, cung cấp cho cơ quan, tổ chức, cá nhân khác. Trừ trường hợp được yêu cầu chia sẻ bởi chủ thể dữ liệu hoặc pháp luật có quy định khác.”.

Article 11. Amending and supplementing Clause 2 of Article 24

Điều 11. Sửa đổi, bổ sung khoản 2 của Điều 24

“2. Order and time limit for processing:

“2. Trình tự, thời hạn giải quyết:

a) An organization or enterprise shall submit 01 set of dossier specified in Clause 1 of this Article directly or via postal services to the Ministry of Public Security or submit the dossier via the National Public Service Portal;

a) Tổ chức, doanh nghiệp nộp 01 bộ hồ sơ quy định tại khoản 1 Điều này trực tiếp hoặc qua dịch vụ bưu chính về Bộ Công an hoặc nộp hồ sơ qua cổng dịch vụ công quốc gia;

b) In case the dossier is incomplete or invalid, within 02 working days from the date of receiving the dossier, the Ministry of Public Security shall be responsible for notifying the organization or enterprise in writing to supplement the dossier;

b) Trường hợp hồ sơ chưa đầy đủ, hợp lệ, trong thời hạn 02 ngày làm việc kể từ ngày nhận được hồ sơ, Bộ Công an có trách nhiệm thông báo bằng văn bản cho tổ chức, doanh nghiệp để bổ sung hồ sơ;

c) Within 02 working days from the date of receiving a complete and valid dossier, the Ministry of Public Security shall be responsible for consulting the Ministry of Science and Technology, the Ministry of National Defense, and the Ministry of Finance in writing;

c) Trong thời hạn 02 ngày làm việc kể từ ngày nhận được hồ sơ đầy đủ, hợp lệ, Bộ Công an có trách nhiệm lấy ý kiến của Bộ Khoa học và Công nghệ, Bộ Quốc phòng, Bộ Tài chính bằng văn bản;

d) Within 07 working days from the date of receiving the written request of the Ministry of Public Security, the ministries shall be responsible for examining, appraising, and sending written responses to the Ministry of Public Security;

d) Trong thời hạn 07 ngày làm việc kể từ ngày nhận được văn bản của Bộ Công an, các bộ có trách nhiệm kiểm tra, thẩm định và có ý kiến trả lời bằng văn bản gửi Bộ Công an;

dd) Within 20 working days from the date of receiving the written responses from the ministries, the Ministry of Public Security shall conduct appraisal, physical inspection at the organization or enterprise, and grant a Certificate of eligibility for electronic authentication service business according to Form XT03 in the Appendix issued with this Decree to qualifying organizations or enterprises; in case of refusal, a written notice clearly stating the reasons must be issued.”.

đ) Trong thời hạn 20 ngày làm việc kể từ ngày nhận được văn bản trả lời của các bộ, Bộ Công an thực hiện việc thẩm định, kiểm tra thực tế tại tổ chức, doanh nghiệp và cấp Giấy xác nhận đủ điều kiện kinh doanh dịch vụ xác thực điện tử theo Mẫu XT03 tại Phụ lục ban hành kèm theo Nghị định này cho tổ chức, doanh nghiệp đủ điều kiện; trường hợp từ chối phải có thông báo bằng văn bản nêu rõ lý do.”.

Article 12. Amending and supplementing Clause 3, Clause 4, and Point b Clause 5 of Article 25

1. Amending and supplementing Clause 3 as follows:

1. Sửa đổi, bổ sung khoản 3 như sau:

“3. Where an organization or enterprise changes any of the information regarding its legal representative, head office address, or transaction name, within 07 working days from the date of receiving a valid dossier, the Ministry of Public Security shall be responsible for appraising and granting confirmation of eligibility for electronic authentication service business to qualifying organizations or enterprises; in case of refusal, a written notice clearly stating the reasons must be issued.”.

“3. Trường hợp tổ chức, doanh nghiệp thay đổi một trong các thông tin về người đại diện theo pháp luật, địa chỉ trụ sở, tên giao dịch thì trong thời hạn 07 ngày làm việc kể từ ngày nhận được hồ sơ hợp lệ, Bộ Công an có trách nhiệm thẩm định, cấp xác nhận đủ điều kiện kinh doanh dịch vụ xác thực điện tử cho tổ chức, doanh nghiệp đủ điều kiện; trường hợp từ chối thay đổi phải thông báo bằng văn bản và nêu rõ lý do.”.

2. Amending and supplementing Clause 4 as follows:

2. Sửa đổi, bổ sung khoản 4 như sau:

“4. Where an organization or enterprise changes any of the information regarding the operational plan and process for providing electronic authentication services specified in Clause 3, Article 23 of this Decree, within 20 working days from the date of receiving a valid dossier, the Ministry of Public Security shall carry out appraisal, consult relevant ministries, conduct physical inspections, and grant confirmation of eligibility for electronic authentication service business to qualifying organizations or enterprises; in case of refusal, a written notice clearly stating the reasons must be issued.”.

“4. Trường hợp tổ chức, doanh nghiệp thay đổi một trong các thông tin về phương án, quy trình hoạt động cung cấp dịch vụ xác thực điện tử quy định tại khoản 3 Điều 23 Nghị định này thì trong thời hạn 20 ngày làm việc kể từ ngày nhận được hồ sơ hợp lệ, Bộ Công an thực hiện việc thẩm định, lấy ý kiến các bộ có liên quan, kiểm tra thực tế và cấp xác nhận đủ điều kiện kinh doanh dịch vụ xác thực điện tử cho tổ chức, doanh nghiệp đủ điều kiện; trường hợp từ chối thay đổi phải thông báo bằng văn bản và nêu rõ lý do.”.

3. Amending and supplementing Point b Clause 5 as follows:

“b) Within 02 working days from the date of receiving a valid dossier, the Ministry of Public Security shall consider and re-issue the Certificate of eligibility for electronic authentication service business to the electronic authentication service provider; in case of refusal, a written notice clearly stating the reasons must be issued.”.

“b) Trong thời hạn 02 ngày làm việc kể từ ngày nhận được hồ sơ hợp lệ, Bộ Công an xem xét và cấp lại Giấy xác nhận đủ điều kiện kinh doanh dịch vụ xác thực điện tử cho tổ chức cung cấp dịch vụ xác thực điện tử; trường hợp từ chối cấp lại phải thông báo bằng văn bản và nêu rõ lý do.”.

Article 13. Amending and supplementing Clause 1 of Article 28

Điều 13. Sửa đổi, bổ sung khoản 1 của Điều 28

“1. Electronic identity cards are presented in the form of a feature and utility of the National Identification Application through accessing the citizen's electronic identity account. The display format of the electronic Identity card in the National Identification Application is identical to that of the Identity card; information of the electronic Identity card displayed in the National Identification Application is information updated in the electronic identification and electronic authentication system.”.

“1. Căn cước điện tử được thể hiện dưới dạng một tính năng, tiện ích của ứng dụng định danh quốc gia thông qua việc truy cập vào tài khoản định danh điện tử của công dân. Hình thức Căn cước điện tử hiển thị trong ứng dụng định danh quốc gia giống hình thức thẻ Căn cước; thông tin Căn cước điện tử hiển thị trong ứng dụng định danh quốc gia là thông tin được cập nhật trong hệ thống định danh và xác thực điện tử.”.

Article 14. Supplementing Clause 3 and Clause 4 after Clause 2 of Article 33

Điều 14. Bổ sung khoản 3, khoản 4 vào sau khoản 2 của Điều 33

“3. Responsibilities of electronic identity subjects:

“3. Trách nhiệm của chủ thể danh tính điện tử:

a) Provide complete and accurate information and papers requested for integration onto the National Identification Application;

a) Cung cấp đầy đủ, chính xác các thông tin, giấy tờ yêu cầu đề nghị tích hợp trên ứng dụng định danh quốc gia;

b) Maintain confidentiality and protect electronic identity accounts and electronic identities;

b) Bảo mật, bảo vệ tài khoản định danh điện tử, danh tính điện tử;

c) Promptly recommend and reflect missing or erroneous information and data on the National Identification Application;

c) Kiến nghị, phản ánh kịp thời các thông tin, dữ liệu còn thiếu, sai sót trên ứng dụng định danh quốc gia;

d) Refrain from creating and submitting multiple administrative procedure dossiers of the same category with unfinalized dossiers at the same time on public services causing overload to the receiving and processing work of the processing agency;

d) Không tạo, nộp nhiều hồ sơ thủ tục hành chính cùng loại với hồ sơ chưa giải quyết xong cùng một thời điểm trên dịch vụ công gây quá tải công tác tiếp nhận, xử lý hồ sơ của cơ quan giải quyết hồ sơ;

dd) Strictly comply with the provisions of law on personal data protection and cybersecurity.

đ) Tuân thủ nghiêm các quy định của pháp luật về bảo vệ dữ liệu cá nhân và an ninh mạng.

4. State agencies, political organizations, socio-political organizations, and other organizations serving public services shall register and develop utilities on the National Public Service Portal or on the National Identification Application to serve citizens and enterprises in performing administrative procedures and public services. For other cases not serving public services or administrative procedures, registration for development shall be carried out according to demand.”.

4. Cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, các tổ chức khác phục vụ dịch vụ công thực hiện đăng ký, phát triển các tiện ích trên Cổng dịch vụ công quốc gia hoặc trên ứng dụng định danh quốc gia để phục vụ người dân, doanh nghiệp thực hiện thủ tục hành chính, dịch vụ công. Đối với các trường hợp khác không phục vụ dịch vụ công, thủ tục hành chính thì đăng ký phát triển theo nhu cầu.”.

Article 15. Supplementing Clause 11, Clause 12, Clause 13, Clause 14, Clause 15, and Clause 16 after Clause 10 of Article 34

Điều 15. Bổ sung khoản 11, khoản 12, khoản 13, khoản 14, khoản 15, khoản 16 vào sau khoản 10 của Điều 34

Provide an official, secure, confidential, and effective communication channel between citizens and the State, citizens and enterprises, and citizens and citizens on the National Identification Application; integrate and link payment accounts, e-wallets, bank cards, and mobile money services on the National Identification Application to perform public service payments, social security payments, and other lawful payment transactions.

“11. Cung cấp kênh giao tiếp chính thức, bảo đảm an toàn, bảo mật, hiệu quả giữa người dân với Nhà nước, người dân với doanh nghiệp và người dân với người dân trên ứng dụng định danh quốc gia; tích hợp, liên kết tài khoản thanh toán, ví điện tử, thẻ ngân hàng, dịch vụ tiền di động trên ứng dụng định danh quốc gia để thực hiện thanh toán dịch vụ công, chi trả an sinh xã hội và các giao dịch thanh toán hợp pháp khác.

12. Invest in, upgrade, re-architect, and develop the electronic identification and electronic authentication system and the National Identification Application to ensure stable operation, readiness to serve a minimum of 10% of Vietnam's population accessing and using simultaneously at the same time, and supplement and meet services and utilities specified in this Decree; invest in infrastructure solutions to ensure electronic identity subjects can access and use services and utilities of the National Identification Application outside the territory of Vietnam.

12. Đầu tư, nâng cấp, tái kiến trúc, phát triển hệ thống định danh và xác thực điện tử, ứng dụng định danh quốc gia đảm bảo vận hành ổn định, sẵn sàng phục vụ tối thiểu 10% dân số Việt Nam truy cập sử dụng đồng thời tại cùng một thời điểm và bổ sung, đáp ứng các dịch vụ, tiện ích quy định tại Nghị định này; đầu tư các giải pháp hạ tầng, đảm bảo chủ thể danh tính điện tử có thể truy cập, sử dụng các dịch vụ, tiện ích của Ứng dụng định danh quốc gia ngoài lãnh thổ Việt Nam.

13. Organize periodic or ad-hoc inspections of the synchronization of information and papers on the National Identification Application to ensure timeliness and efficiency; organize inspections to ensure regulations on personal data protection and cybersecurity; organize inspections of the linking and authentication of electronic transaction accounts on digital platforms with electronic identity accounts prior to use.

13. Tổ chức kiểm tra định kỳ hoặc đột xuất việc thực hiện đồng bộ các thông tin, giấy tờ trên ứng dụng định danh quốc gia đảm bảo kịp thời, hiệu quả; tổ chức kiểm tra đảm bảo các quy định về bảo vệ dữ liệu cá nhân, an ninh mạng; tổ chức kiểm tra việc thực hiện liên kết, xác thực của tài khoản giao dịch điện tử trên các nền tảng số với tài khoản định danh điện tử trước khi sử dụng.

14. Promulgate procedures for connecting and synchronizing citizen information data, electronic papers, and results of administrative procedure resolution with the electronic identification and electronic authentication system.

14. Ban hành quy trình về việc kết nối, đồng bộ dữ liệu thông tin công dân, giấy tờ điện tử, kết quả giải quyết thủ tục hành chính với hệ thống định danh và xác thực điện tử.

15. Coordinate with ministries, ministerial-level agencies, and People's Committees of provinces and cities to conduct reviews to propose to the Prime Minister additions and updates to types of papers of agencies, organizations, and individuals integrated and updated on the National Identification Application.

15. Phối hợp với các bộ, cơ quan ngang bộ, Ủy ban nhân dân tỉnh, thành phố thực hiện rà soát để đề xuất Thủ tướng Chính phủ bổ sung, cập nhật các loại giấy tờ của cơ quan, tổ chức, cá nhân được tích hợp, cập nhật trên ứng dụng định danh quốc gia.

16. Promulgate detailed guidelines on the payment of subsidies, pensions, insurance, and other payments via social security beneficiary accounts on the National Identification Application.”.

16. Ban hành hướng dẫn chi tiết về việc chi trả các khoản hỗ trợ, hưu trí, bảo hiểm và các khoản chi trả khác qua tài khoản hưởng an sinh xã hội trên ứng dụng định danh quốc gia.”.

Article 16. Amending and supplementing Article 35

The Ministry of Science and Technology shall announce national digital platforms deployed by ministries, sectors, and enterprises.”.

Article 17. Supplementing Clause 4 and Clause 5 after Clause 3 of Article 36

“4. Based on written proposals and schemes of ministries, ministerial-level agencies, and People's Committees of provinces and cities, the Ministry of Finance shall submit to competent authorities for promulgation, or promulgate within its competence, legal documents prescribing rates of fee and charge exemptions and reductions for the performance of administrative procedures on the National Identification Application with respect to fees and charges in the List of fees and charges promulgated together with the Law on Fees and Charges.

“4. Căn cứ văn bản kiến nghị và đề án của các bộ, cơ quan ngang bộ, Ủy ban nhân dân tỉnh, thành phố, Bộ Tài chính trình cấp có thẩm quyền ban hành hoặc ban hành theo thẩm quyền văn bản quy định mức miễn, giảm phí, lệ phí trong việc thực hiện thủ tục hành chính trên ứng dụng định danh quốc gia đối với các khoản phí, lệ phí trong Danh mục phí, lệ phí ban hành kèm theo Luật phí và lệ phí.

Balance and propose allocations of state budget (development investment, recurrent) to ministries, ministerial-level agencies, and People's Committees of provinces and cities in accordance with the Law on State Budget, the Law on Public Investment, and relevant legislation. Specifically for funding to perform tasks in the fields of science, technology, innovation, and digital transformation, ministries, central agencies, and localities shall submit proposals to the state administrative agency for science, technology, innovation, and digital transformation of the same level for overall synthesis.”.

5. Cân đối, đề xuất bố trí ngân sách nhà nước (đầu tư phát triển, thường xuyên) cho các bộ, cơ quan ngang bộ, Ủy ban nhân dân tỉnh, thành phố theo quy định của Luật Ngân sách nhà nước, Luật Đầu tư công và các luật pháp liên quan. Article 18. Supplementing Clause 4, Clause 5, Clause 6, Clause 7, and Clause 8 after Clause 3 of Article 39

“4. Connect with the electronic identification and electronic authentication system to pay subsidies, pensions, insurance, and other payments via social security beneficiary accounts on the National Identification Application.

“4. Thực hiện kết nối với hệ thống định danh và xác thực điện tử để chi trả các khoản hỗ trợ, hưu trí, bảo hiểm và các khoản chi trả khác qua tài khoản hưởng an sinh xã hội trên ứng dụng định danh quốc gia.

5. Coordinate with the Ministry of Public Security in deploying plans to integrate and update papers issued to individuals and papers issued to agencies and organizations (according to the list in the Appendix) related to fields under their management competence from specialized databases into the electronic identification and electronic authentication system.

5. Phối hợp với Bộ Công an triển khai phương án tích hợp, cập nhật các giấy tờ cấp cho cá nhân và giấy tờ cấp cho cơ quan, tổ chức (theo danh mục tại Phụ lục) liên quan đến các lĩnh vực thuộc thẩm quyền quản lý từ cơ sở dữ liệu chuyên ngành vào hệ thống định danh và xác thực điện tử.

6. Review fees and charges under their management sectors and fields, formulate Schemes proposing fee and charge exemptions and reductions for administrative procedures performed on the National Identification Application, and submit them to the Ministry of Finance in accordance with the law on fees and charges.

6. Rà soát các khoản phí, lệ phí thuộc ngành, lĩnh vực quản lý, xây dựng Đề án đề xuất việc miễn, giảm phí, lệ phí đối với các thủ tục hành chính được thực hiện trên ứng dụng định danh quốc gia và gửi Bộ Tài chính theo quy định của pháp luật về phí, lệ phí.

7. Connect and synchronize data of subjects eligible for social allowances with the electronic identification and electronic authentication system.

7. Thực hiện kết nối, đồng bộ dữ liệu đối tượng thuộc diện được hưởng trợ cấp xã hội với hệ thống định danh và xác thực điện tử.

8. Review and update subjects eligible for emergency social assistance as prescribed into the electronic identification and electronic authentication system.”.

8. Thực hiện rà soát, cập nhật các đối tượng thuộc diện được hưởng trợ giúp xã hội khẩn cấp theo quy định vào hệ thống định danh và xác thực điện tử.”.

Article 19. Supplementing Clause 9 and Clause 10 after Clause 8 of Article 40

Điều 19. Bổ sung khoản 9, khoản 10 vào sau khoản 8 của Điều 40

“9. Electronic transaction accounts under the Law on Electronic Transactions on digital platforms serving activities in education, digital mass literacy, securities, telecommunications, banking, e-commerce (sellers, livestream sellers, and affiliate marketers under the Law on Electronic Commerce), electronic invoices, transport business, tourism business, pharmaceutical business, medical examination and treatment, and social networks in Vietnam must be linked and authenticated with electronic identity accounts. Electronic transaction accounts on digital platforms serving national defense, security, and cross-border services shall be linked and authenticated with electronic identity accounts prior to use when digital platforms satisfy all conditions and are connected to the electronic identification and electronic authentication platform.

“9. Tài khoản giao dịch điện tử theo Luật Giao dịch điện tử trên các nền tảng số phục vụ hoạt động thuộc lĩnh vực giáo dục, bình dân học vụ số, chứng khoán, viễn thông, ngân hàng, thương mại điện tử (người bán, người livestream bán hàng và người tiếp thị liên kết theo quy định của Luật Thương mại điện tử), hóa đơn điện tử, kinh doanh vận tải, kinh doanh du lịch, kinh doanh dược, khám bệnh, chữa bệnh, mạng xã hội tại Việt Nam phải được liên kết, xác thực với tài khoản định danh điện tử. Các tài khoản giao dịch điện tử trên các nền tảng số phục vụ hoạt động quốc phòng, an ninh, dịch vụ xuyên biên giới thực hiện liên kết, xác thực với tài khoản định danh điện tử trước khi sử dụng khi các nền tảng số đáp ứng đủ điều kiện và được kết nối với nền tảng định danh và xác thực điện tử.

10. For fields other than those specified in Clause 9 of this Article, Ministers and Heads of ministerial-level agencies shall promulgate specific lists of online transactions across sectors that are mandatory to link and authenticate with electronic identity accounts prior to use.”.

10. Đối với các lĩnh vực khác ngoài quy định tại khoản 9 Điều này, Bộ trưởng, Thủ trưởng cơ quan ngang bộ ban hành danh mục cụ thể các giao dịch trực tuyến trên các lĩnh vực bắt buộc liên kết, xác thực với tài khoản định danh điện tử trước khi sử dụng.”.

Article 20. Implementation provisions

Điều 20. Điều khoản thi hành

1. Amending and supplementing a number of articles of Government's Decree No. 77/2020/NĐ-CP dated July 01, 2020 prescribing the management and exploitation of information in the National Database on Immigration; online public services serving immigration issuance, management, and control through automated control gates, as amended and supplemented by Government's Decree No. 67/2024/NĐ-CP dated June 25, 2024, as follows:

1. Sửa đổi, bổ sung một số điều của Nghị định số 77/2020/NĐ-CP ngày 01 tháng 7 năm 2020 của Chính phủ quy định việc quản lý, khai thác thông tin trong Cơ sở dữ liệu quốc gia về xuất nhập cảnh; dịch vụ công trực tuyến phục vụ cấp, quản lý, kiểm soát xuất nhập cảnh bằng cổng kiểm soát tự động đã được sửa đổi, bổ sung một số điều của Nghị định số 67/2024/NĐ-CP ngày 25 tháng 6 năm 2024 của Chính phủ như sau:

a) Công dân Việt Nam đã được thu thập, cập nhật đủ thông tin vào Cơ sở dữ liệu quốc gia về xuất nhập cảnh hoặc đã được cấp tài khoản định danh điện tử mức độ 02;

b) Foreigners whose information has been fully collected and updated into the National Database on Immigration or who have been granted electronic identity accounts.

b) Người nước ngoài đã được thu thập, cập nhật đủ thông tin vào Cơ sở dữ liệu quốc gia về xuất nhập cảnh hoặc đã được cấp tài khoản định danh điện tử.

3. The Ministry of Public Security shall take the lead, coordinating with the Ministry of National Defense and the Ministry of Foreign Affairs, in guiding categories of eligible subjects mentioned in Clause 1 and Clause 2 of this Article to exit and enter through automated control gates based on practical situations, ensuring national defense, national security, and social order and safety.”.

3. Bộ Công an chủ trì, phối hợp với Bộ Quốc phòng, Bộ Ngoại giao hướng dẫn diện đối tượng đủ điều kiện nêu tại khoản 1 và khoản 2 Điều này được xuất cảnh, nhập cảnh qua cổng kiểm soát tự động trên cơ sở tình hình thực tiễn, bảo đảm quốc phòng; an ninh quốc gia và trật tự, an toàn xã hội.”.

b) Annulling Article 11.

2. Supplementing the lists of papers issued to agencies, organizations, and individuals integrated and updated on the National Identification Application into the Appendix as follows:

2. Bổ sung danh mục giấy tờ cấp cho cơ quan, tổ chức, cá nhân tích hợp, cập nhật trên ứng dụng định danh quốc gia vào Phụ lục như sau:

a) List 1: Papers issued to individuals integrated and updated on the National Identification Application;

a) Danh mục 1: Giấy tờ cấp cho cá nhân tích hợp, cập nhật trên ứng dụng định danh quốc gia;

b) List 2: Papers issued to agencies and organizations integrated and updated on the National Identification Application.

b) Danh mục 2: Giấy tờ cấp cho cơ quan, tổ chức tích hợp, cập nhật trên ứng dụng định danh quốc gia.

3. This Decree takes effect from September 28, 2026.

3. Nghị định này có hiệu lực thi hành từ ngày 28 tháng 9 năm 2026.

National digital platforms must integrate the use of electronic identity accounts in authentication, login, and execution of transactions between agencies, organizations, and individuals and other agencies, organizations, and individuals no later than December 31, 2026.

Các nền tảng số quốc gia phải tích hợp việc sử dụng tài khoản định danh điện tử trong xác thực, đăng nhập, thực hiện các giao dịch giữa các cơ quan, tổ chức, cá nhân với cơ quan, tổ chức, cá nhân khác chậm nhất trước ngày 31 tháng 12 năm 2026.

Electronic transaction accounts specified in Clause 9, Article 40 of this Decree (except in the banking sector) created prior to the effective date of this Decree must be linked and authenticated with electronic identity accounts no later than December 31, 2026.

Các tài khoản giao dịch điện tử quy định tại khoản 9 Điều 40 Nghị định này (trừ lĩnh vực ngân hàng) đã tạo lập trước ngày Nghị định này có hiệu lực thì phải được liên kết, xác thực với tài khoản định danh điện tử chậm nhất trước ngày 31 tháng 12 năm 2026.

Electronic transaction accounts specified in Clause 9, Article 40 of this Decree in the banking sector created prior to the effective date of this Decree must be linked and authenticated with electronic identity accounts no later than June 30, 2027.

Các tài khoản giao dịch điện tử quy định tại khoản 9 Điều 40 Nghị định này thuộc lĩnh vực ngân hàng đã tạo lập trước ngày Nghị định này có hiệu lực phải được liên kết, xác thực với tài khoản định danh điện tử chậm nhất trước ngày 30 tháng 6 năm 2027.

4. The Ministry of Public Security shall be responsible for guiding, inspecting, and urging the implementation of this Decree. During implementation, the Ministry of Public Security shall coordinate with the Ministry of Science and Technology in synthesizing and addressing issues according to state management functions. Where necessary, report to the Prime Minister for consideration and decision.

4. Bộ Công an chịu trách nhiệm hướng dẫn, kiểm tra, đôn đốc việc thực hiện Nghị định này. Trong quá trình thực hiện, Bộ Công an phối hợp với Bộ Khoa học và Công nghệ tổng hợp xử lý các vấn đề theo chức năng quản lý nhà nước. Trường hợp cần thiết báo cáo Thủ tướng Chính phủ xem xét, quyết định.

5. Ministers, Heads of ministerial-level agencies, Chairpersons of People's Committees of provinces and cities, and relevant agencies, organizations, units, and individuals shall be responsible for the implementation of this Decree.

5. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố và các cơ quan, tổ chức, đơn vị, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.
