At the proposal of the Director General of the Department of People with Meritorious Services;

The Minister of Home Affairs promulgates the Circular regulating the creation of data and the management and use of the database on people with meritorious services to the revolution.

Bộ trưởng Bộ Nội vụ ban hành Thông tư quy định về tạo lập dữ liệu và quản lý, sử dụng cơ sở dữ liệu về người có công với cách mạng.

Chapter I

Chương I

GENERAL PROVISIONS

QUY ĐỊNH CHUNG

Article 1. Scope of regulation

Điều 1. Phạm vi điều chỉnh

This Circular regulates the creation, management and use of the database on people with meritorious services to the revolution.

Thông tư này quy định về tạo lập, quản lý và sử dụng cơ sở dữ liệu về người có công với cách mạng.

Article 2. Subjects of application

Điều 2. Đối tượng áp dụng

This Circular applies to agencies, organizations, and individuals performing the creation, management, and use of the database on people with meritorious services to the revolution.

Thông tư này áp dụng đối với các cơ quan, tổ chức, cá nhân thực hiện tạo lập, quản lý và sử dụng cơ sở dữ liệu về người có công với cách mạng.

Article 3. Interpretation of terms

Điều 3. Giải thích từ ngữ

In this Circular, the terms below are construed as follows:

Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. Data on people with meritorious services to the revolution means digital data reflecting information on the confirmation, recognition, and implementation of preferential regimes for people with meritorious services to the revolution and relatives of people with meritorious services to the revolution in accordance with the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution and other relevant specialized laws.

1. Dữ liệu về người có công với cách mạng là dữ liệu số phản ánh thông tin về việc xác nhận, công nhận và thực hiện chế độ ưu đãi đối với người có công với cách mạng và thân nhân của người có công với cách mạng theo quy định của Pháp lệnh Ưu đãi người có công với cách mạng và pháp luật chuyên ngành khác có liên quan.

2. Component databases of the database on people with meritorious services to the revolution mean databases developed by the Ministry of Home Affairs according to plans to serve the development of science, technology, innovation, and national digital transformation.

2. Cơ sở dữ liệu thành phần của cơ sở dữ liệu về người có công với cách mạng là các cơ sở dữ liệu được Bộ Nội vụ xây dựng theo kế hoạch để phục vụ phát triển khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số quốc gia.

3. Shared data on people with meritorious services to the revolution means basic and core data on people with meritorious services to the revolution that are created, standardized, stored, and uniformly managed nationwide.

3. Dữ liệu dùng chung về người có công với cách mạng là dữ liệu cơ bản, cốt lõi về người có công với cách mạng được tạo lập, chuẩn hóa, lưu trữ và quản lý thống nhất trên phạm vi toàn quốc.

4. Master source data (original data) of the database on people with meritorious services to the revolution means data created during the process of receiving and processing dossiers, implementing preferential policies for people with meritorious services to the revolution by competent agencies and organizations; or collected and created from the digitization of original papers and documents concerning beneficiaries of preferential policies for people with meritorious services to the revolution.

4. Dữ liệu gốc của cơ sở dữ liệu về người có công với cách mạng là dữ liệu được tạo lập trong quá trình tiếp nhận, giải quyết hồ sơ, thực hiện chính sách ưu đãi người có công với cách mạng của cơ quan, tổ chức có thẩm quyền; hoặc được thu thập, tạo lập từ việc số hóa bản chính giấy tờ, tài liệu về người hưởng chính sách ưu đãi người có công với cách mạng.

5. Master data of the database on people with meritorious services to the revolution means data containing the most basic and characteristic information to identify and describe the managed subjects of the database.

5. Dữ liệu chủ của cơ sở dữ liệu về người có công với cách mạng là dữ liệu chứa thông tin cơ bản, đặc trưng nhất để định danh và mô tả đối tượng quản lý của cơ sở dữ liệu.

6. Reference data of the database on people with meritorious services to the revolution means data created and managed by national databases, specialized databases, or other databases, which are connected, shared, and synchronized for use and comparison without re-entry.

6. Dữ liệu tham chiếu của cơ sở dữ liệu về người có công với cách mạng là dữ liệu do cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành hoặc cơ sở dữ liệu khác tạo lập, quản lý, được kết nối, chia sẻ, đồng bộ để sử dụng, đối chiếu mà không phải nhập lại.

7. The list of master source data, master data, and reference data of the database on people with meritorious services to the revolution is prescribed in Appendix 1, Appendix 2, and Appendix 3 issued together with this Circular.

7. Danh mục dữ liệu gốc, dữ liệu chủ, dữ liệu tham chiếu của cơ sở dữ liệu về người có công với cách mạng quy định tại Phụ lục 1, Phụ lục 2, Phụ lục 3 ban hành kèm theo Thông tư này.

Article 4. Principles for the creation, management, and use of the database on people with meritorious services to the revolution

Điều 4. Nguyên tắc tạo lập, quản lý và sử dụng cơ sở dữ liệu người có công về người có công với cách mạng

1. The database on people with meritorious services to the revolution is constructed to serve the state management work of the Ministry of Home Affairs and relevant ministries and sectors, serve agencies, organizations, and individuals in implementing preferential policies for people with meritorious services to the revolution, with a view to simplifying administrative procedures, cutting dossier components, and facilitating the processing of online public services; the creation, management, connection, sharing, exploitation, and use must comply with legal provisions; data must be synchronized and unified from the central to local levels, conforming to technical standards and regulations on structure, format, connection protocol, and data interoperability requirements.

1. Cơ sở dữ liệu về người có công với cách mạng được xây dựng phục vụ công tác quản lý nhà nước của Bộ Nội vụ và các Bộ, ngành có liên quan, phục vụ cơ quan, tổ chức, cá nhân trong thực hiện chính sách ưu đãi người có công với cách mạng, nhằm đơn giản hóa thủ tục hành chính, cắt giảm thành phần hồ sơ, tạo thuận lợi trong quá trình giải quyết các dịch vụ công trực tuyến; việc tạo lập, quản lý, kết nối, chia sẻ, khai thác và sử dụng phải tuân thủ quy định của pháp luật; dữ liệu phải đồng bộ, thống nhất từ Trung ương đến địa phương, phù hợp tiêu chuẩn, quy chuẩn kỹ thuật về cấu trúc, định dạng, giao thức kết nối và yêu cầu liên thông dữ liệu.

2. Data on people with meritorious services to the revolution are collected from master source data, minimizing duplicate collection; prioritizing the connection, sharing, and reuse of data already available in national databases, the Home Affairs sector database, and other databases in accordance with law. Metadata on people with meritorious services to the revolution means data describing the structure, information type, size, origin, and attributes of data on people with meritorious services to the revolution, serving the management, search, connection, sharing, and ensuring data reusability.

2. Dữ liệu về người có công với cách mạng được thu thập từ nguồn dữ liệu gốc, hạn chế tối đa việc thu thập trùng lặp; ưu tiên kết nối, chia sẻ, tái sử dụng dữ liệu đã có trong các cơ sở dữ liệu quốc gia, cơ sở dữ liệu ngành Nội vụ và các cơ sở dữ liệu khác theo quy định của pháp luật. Siêu dữ liệu về người có công với cách mạng là dữ liệu mô tả cấu trúc, kiểu thông tin, kích thước, nguồn gốc và các thuộc tính của dữ liệu về người có công với cách mạng, phục vụ việc quản lý, tra cứu, kết nối, chia sẻ và bảo đảm khả năng tái sử dụng dữ liệu.

3. The connection and sharing of data internally within the Ministry of Home Affairs shall be carried out via the Local Government Service Platform / Local Data Open Platform (LGSP/LDOP) of the Ministry of Home Affairs; the connection and sharing of data with national databases and databases of ministries, sectors, and localities shall comply with Circular No. 19/2026/TT-BNV dated August 20, 2026 of the Minister of Home Affairs regulating the management, updating, connection, sharing, exploitation, and use of the Home Affairs sector database (Circular No. 19/2026/TT-BNV) and other legal provisions on data connection and sharing.

3. Việc kết nối, chia sẻ dữ liệu trong nội bộ Bộ Nội vụ được thực hiện thông qua Nền tảng tích hợp, chia sẻ, điều phối dữ liệu của Bộ Nội vụ; việc kết nối, chia sẻ dữ liệu với cơ sở dữ liệu quốc gia, cơ sở dữ liệu của các Bộ, ngành, địa phương được thực hiện theo quy định tại Thông tư số 19/2026/TT-BNV ngày 20 tháng 8 năm 2026 của Bộ trưởng Bộ Nội vụ quy định về quản lý, cập nhật, kết nối, chia sẻ, khai thác và sử dụng cơ sở dữ liệu ngành Nội vụ (Thông tư số 19/2026/TT-BNV ) và quy định khác của pháp luật về kết nối, chia sẻ dữ liệu.

4. Agencies and organizations must ensure safety, security, and personal data protection as prescribed; for historical data, data generated from paper files, or cases of discrepancies between data sources, inspection, comparison, verification, and standardization must be carried out in accordance with regulations.

4. Các cơ quan, tổ chức phải bảo đảm an toàn, bảo mật, bảo vệ dữ liệu cá nhân theo quy định; đối với dữ liệu lịch sử, dữ liệu hình thành từ hồ sơ giấy hoặc trường hợp thông tin có sự khác biệt giữa các nguồn dữ liệu phải thực hiện việc kiểm tra, đối chiếu, xác minh và chuẩn hóa theo quy định.

5. Ensure a clear delineation of responsibilities among data management agencies, data exploitation agencies, and individuals assigned to administer and use data throughout the entire database operation process; the creation, updating, modification, exploitation, and use of data must ensure the complete retention of dossiers, data processing logs, and electronic evidence generated in accordance with the law on archives.

5. Bảo đảm phân định rõ trách nhiệm của cơ quan quản lý dữ liệu, cơ quan khai thác dữ liệu và cá nhân được giao quản trị, sử dụng dữ liệu trong toàn bộ quá trình vận hành cơ sở dữ liệu; việc tạo lập, cập nhật, chỉnh sửa, khai thác và sử dụng dữ liệu phải bảo đảm lưu giữ đầy đủ hồ sơ, nhật ký xử lý dữ liệu và bằng chứng điện tử phát sinh theo quy định của pháp luật về lưu trữ.

6. Ensure compliance with the National Digital Architecture Framework, National Data Architecture Framework, National Data Governance and Management Framework, Shared Data Dictionary; satisfy technical standards and regulations; ensure the capacity for data connection and sharing as prescribed by law.

6. Bảo đảm phù hợp với Khung kiến trúc tổng thể quốc gia số, Khung kiến trúc dữ liệu quốc gia, Khung quản trị, quản lý dữ liệu quốc gia, Từ điển dữ liệu dùng chung; đáp ứng tiêu chuẩn, quy chuẩn kỹ thuật; bảo đảm khả năng kết nối, chia sẻ dữ liệu theo quy định của pháp luật.

CREATION, MANAGEMENT, AND USE OF THE DATABASE ON PEOPLE WITH MERITORIOUS SERVICES TO THE REVOLUTION

Article 5. Component databases of the database on people with meritorious services to the revolution

Điều 5. Cơ sở dữ liệu thành phần của cơ sở dữ liệu về người có công với cách mạng

Component databases of the database on people with meritorious services to the revolution are constituent databases of the database on people with meritorious services to the revolution, comprising the following databases:

Cơ sở dữ liệu thành phần của cơ sở dữ liệu về người có công với cách mạng là các cơ sở dữ liệu cấu thành cơ sở dữ liệu về người có công với cách mạng, gồm các cơ sở dữ liệu sau:

1. The database on beneficiaries of preferential policies for people with meritorious services is a database serving state management in the field of preferential treatment for people with meritorious services, comprising the following data groups:

1. Cơ sở dữ liệu người hưởng chính sách ưu đãi người có công là cơ sở dữ liệu phục vụ công tác quản lý nhà nước lĩnh vực ưu đãi người có công, bao gồm các nhóm dữ liệu sau:

a) Data on personal backgrounds of people with meritorious services.

a) Dữ liệu về nhân thân người có công.

b) Data on beneficiaries of preferential policies for people with meritorious services under the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution.

b) Dữ liệu về người hưởng các chính sách ưu đãi người có công theo Pháp lệnh Ưu đãi người có công với cách mạng.

c) Data on the payment of allowances and subsidies.

c) Dữ liệu về chi trả trợ cấp, phụ cấp.

d) Data on the implementation of preferential policies other than allowances for people with meritorious services and their relatives.

d) Dữ liệu về thực hiện các chính sách ưu đãi ngoài trợ cấp đối với người có công và thân nhân người có công.

2. The database on martyrs, martyrs' graves, and martyrs' cemeteries is a database serving state management of martyrs, martyrs' graves, and works commemorating martyrs, comprising the following data groups:

2. Cơ sở dữ liệu về liệt sĩ, mộ liệt sĩ và nghĩa trang liệt sĩ là cơ sở dữ liệu phục vụ công tác quản lý nhà nước về liệt sĩ, mộ liệt sĩ và công trình ghi công liệt sĩ, bao gồm các nhóm dữ liệu sau:

a) Data on martyrs, comprising information fields recorded in death notices or certificates of death in action.

a) Dữ liệu về liệt sĩ gồm các trường thông tin ghi trong giấy báo tử hoặc giấy chứng nhận hy sinh.

b) Data on martyrs' relatives named in dossiers of martyrs' recognition.

c) Data on martyrs' graves in martyrs' cemeteries and martyrs' graves managed by families.

3. The DNA database of martyrs and relatives is a database serving state management of identifying the remains of martyrs, comprising the following data groups:

3. Cơ sở dữ liệu ADN của liệt sĩ và thân nhân là cơ sở dữ liệu phục vụ công tác quản lý nhà nước về xác định danh tính hài cốt liệt sĩ, bao gồm các nhóm dữ liệu sau:

a) Data exploited from data in Clause 1 and Clause 2 of this Article.

a) Dữ liệu khai thác từ dữ liệu tại khoản 1, khoản 2 Điều này.

b) Data on sampling martyrs' remains in martyrs' cemeteries and the gathering and searching for martyrs' remains.

b) Dữ liệu về lấy mẫu hài cốt liệt sĩ trong nghĩa trang liệt sĩ và quy tập, tìm kiếm hài cốt liệt sĩ.

c) Data on professional conclusions of DNA assessment of martyrs' remains and martyrs' relatives, and identification of martyrs' remains (not storing gene sequence data).

c) Dữ liệu về kết luận chuyên môn giám định ADN hài cốt liệt sĩ, thân nhân liệt sĩ và xác định danh tính hài cốt liệt sĩ (không lưu trữ dữ liệu trình tự gen).

d) Data on dossiers requesting DNA assessment of martyrs and DNA of martyrs' relatives to identify martyrs' remains and dossiers requesting identification of martyrs' remains by empirical methods.

d) Dữ liệu về hồ sơ đề nghị giám định ADN liệt sĩ, ADN thân nhân liệt sĩ để xác định danh tính hài cốt liệt sĩ và hồ sơ đề nghị xác định danh tính hài cốt liệt sĩ bằng phương pháp thực chứng.

dd) Data on assessment units participating in the identification of martyrs' remains.

đ) Dữ liệu về các đơn vị giám định tham gia thực hiện xác định danh tính hài cốt liệt sĩ.

e) Data on units sampling martyrs' remains and sampling martyrs' relatives.

4. Details of data fields of each component database prescribed in Clauses 1, 2, and 3 of this Article are specifically prescribed in Appendix 1, Appendix 2, and Appendix 3 issued together with this Circular.

Article 7. Collecting, creating, and updating data to form the database on people with meritorious services to the revolution

Điều 7. Thu thập, tạo lập, cập nhật dữ liệu để hình thành cơ sở dữ liệu về người có công với cách mạng

1. Sources for creating and updating data

1. Nguồn tạo lập, cập nhật dữ liệu

a) Data from business processes for resolving administrative procedures are created from results of resolving administrative procedures of competent agencies as prescribed in the Government's Decree No. 131/2021/ND-CP dated December 30, 2021, detailing and providing measures for the implementation of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution.

a) Dữ liệu từ quy trình nghiệp vụ giải quyết các thủ tục hành chính được tạo lập từ kết quả giải quyết thủ tục hành chính của cơ quan có thẩm quyền theo quy định tại Nghị định số 131/2021/NĐ-CP ngày 30 tháng 12 năm 2021 của Chính phủ quy định chi tiết và biện pháp thi hành Pháp lệnh Ưu đãi người có công với cách mạng.

b) Data from statistical activities, digitization, and information standardization are created and updated on the basis of archival records and documents under plans of localities, agencies, and units in accordance with the law on archives, statistics, and relevant laws.

b) Dữ liệu từ hoạt động thống kê, số hóa, chuẩn hóa thông tin được tạo lập, cập nhật trên cơ sở hồ sơ, tài liệu lưu trữ theo kế hoạch của các địa phương, cơ quan, đơn vị theo quy định của pháp luật về lưu trữ, thống kê và pháp luật có liên quan.

c) Connected and shared data shall be automatically formed at the time of synchronization from other information systems, national databases, and specialized databases in accordance with the law on data and relevant laws.

c) Dữ liệu được kết nối, chia sẻ sẽ hình thành tự động theo thời điểm đồng bộ từ các hệ thống thông tin, cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành khác theo quy định của pháp luật về dữ liệu và pháp luật có liên quan.

a) Data created and updated as prescribed at Point a, Clause 1 of this Article shall comply with the time prescribed in legal documents in the field of people with meritorious services to the revolution.

b) Data created and updated as prescribed at Point b, Clause 1 of this Article shall follow approved plans of agencies and units managing records and documents and must be inspected, compared, authenticated, and standardized in accordance with regulations on data standards, technical regulations, and shared master lists before being updated into the database.

b) Dữ liệu được tạo lập, cập nhật quy định tại điểm b khoản 1 Điều này theo kế hoạch được phê duyệt của cơ quan, đơn vị quản lý hồ sơ, tài liệu và phải được kiểm tra, đối chiếu, xác thực, chuẩn hóa theo quy định về tiêu chuẩn dữ liệu, quy chuẩn kỹ thuật và danh mục dùng chung trước khi cập nhật vào cơ sở dữ liệu.

c) Data prescribed at Point c, Clause 1 of this Article shall be synchronized in real time from information systems, national databases, and specialized databases.

c) Dữ liệu quy định tại điểm c khoản 1 Điều này theo thời gian thực được đồng bộ từ các hệ thống thông tin, cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành.

3. Data approval

a) Competent persons of agencies and units are responsible for checking and approving data by digital signature or electronic authentication method on the database system.

a) Người có thẩm quyền của cơ quan, đơn vị có trách nhiệm kiểm tra, phê duyệt dữ liệu bằng chữ ký số hoặc phương thức xác thực điện tử trên hệ thống cơ sở dữ liệu.

b) In case a competent person for approval is absent or cannot carry out data approval within the prescribed time limit, authorization in writing, electronic authorization, or substitute approval must be conducted in accordance with internal file management regulations to ensure timeliness.

b) Trường hợp người có thẩm quyền phê duyệt vắng mặt hoặc không thể thực hiện việc phê duyệt dữ liệu trong thời hạn quy định thì phải thực hiện việc ủy quyền bằng văn bản hoặc ủy quyền điện tử hoặc phê duyệt thay thế theo quy định về quản lý hồ sơ nội bộ để bảo đảm tính kịp thời.

c) Upon detecting errors in data creation and updating, agencies and units responsible for creating and updating data shall make a record, carry out inspection and verification, and execute data adjustment and updating in accordance with their competence and legal provisions.

c) Khi phát hiện sai sót trong tạo lập, cập nhật dữ liệu, cơ quan, đơn vị có trách nhiệm tạo lập, cập nhật dữ liệu lập biên bản, tiến hành kiểm tra, xác minh và thực hiện điều chỉnh, cập nhật dữ liệu theo đúng thẩm quyền và quy định của pháp luật.

4. Other provisions on updating data shall comply with the provisions of Article 7 of Circular No. 19/2026/TT-BNV.

Article 8. Issuance and management of accounts for accessing the database on people with meritorious services to the revolution

Điều 8. Cấp và quản lý tài khoản truy cập cơ sở dữ liệu về người có công với cách mạng

1. Access to the database on people with meritorious services to the revolution shall be made through accounts granted by the Department of People with Meritorious Services to agencies, organizations, and individuals in accordance with their functions, tasks, and scope of data exploitation and use, and access accounts shall be periodically reviewed.

1. Việc truy cập cơ sở dữ liệu về người có công với cách mạng được thực hiện thông qua tài khoản do Cục Người có công cấp cho cơ quan, tổ chức, cá nhân phù hợp với chức năng, nhiệm vụ và phạm vi khai thác, sử dụng dữ liệu và được định kỳ rà soát tài khoản truy cập.

2. Agencies, organizations, and individuals granted accounts are responsible for account security, data confidentiality, and managing and using accounts in accordance with regulations. The management system must use multi-factor authentication solutions upon login and retain authorization history according to system log retention times.

2. Cơ quan, tổ chức, cá nhân được cấp tài khoản chịu trách nhiệm bảo mật tài khoản, bảo mật dữ liệu và quản lý, sử dụng tài khoản theo quy định. Hệ thống quản lý phải sử dụng giải pháp xác thực nhiều lớp khi đăng nhập và lưu lịch sử cấp quyền theo thời gian lưu nhật ký hệ thống.

3. Accounts shall be immediately revoked or locked from access in the following cases:

3. Tài khoản được thu hồi, khóa truy cập ngay trong các trường hợp sau:

a) The agency or organization is dissolved or changes its functions such that it no longer has access competence.

a) Cơ quan, tổ chức giải thể hoặc thay đổi chức năng không còn thẩm quyền truy cập.

b) The individual violates the law, is disciplined in relation to the database, retires, resigns, transfers work, or is mobilized or rotated to another unit.

b) Cá nhân vi phạm pháp luật, bị kỷ luật liên quan đến cơ sở dữ liệu, nghỉ hưu, thôi việc, chuyển công tác, điều động, luân chuyển sang đơn vị khác.

Article 9. Maintaining and managing data changes in the database on people with meritorious services to the revolution

Điều 9. Duy trì, quản lý sự thay đổi dữ liệu trong cơ sở dữ liệu về người có công với cách mạng

1. Data on people with meritorious services to the revolution must be regularly maintained to ensure completeness, accuracy, consistency, integrity, timeliness, and conformity with the requirements of state management of preferential treatment for people with meritorious services.

1. Dữ liệu về người có công với cách mạng phải được duy trì thường xuyên nhằm bảo đảm tính đầy đủ, chính xác, thống nhất, toàn vẹn, kịp thời, phù hợp với yêu cầu quản lý nhà nước về ưu đãi người có công.

2. When there are changes in information, master source data, legal regulations, data standards, shared master lists, or management requirements, the database management agency shall be responsible for updating, adjusting, or processing data according to its competence. The modification and adjustment of data must ensure traceability of origin, time of change, executing entity, and change content; the history of data changes shall be recorded on the system as prescribed.

2. Khi có sự thay đổi về thông tin, dữ liệu gốc, quy định của pháp luật, tiêu chuẩn dữ liệu, danh mục dùng chung hoặc yêu cầu quản lý, cơ quan quản lý cơ sở dữ liệu có trách nhiệm cập nhật, hiệu chỉnh hoặc xử lý dữ liệu theo thẩm quyền. Việc thay đổi, hiệu chỉnh dữ liệu phải bảo đảm khả năng truy xuất nguồn gốc, thời điểm thay đổi, chủ thể thực hiện và nội dung thay đổi; lịch sử thay đổi dữ liệu được ghi nhận trên hệ thống theo quy định.

3. Data shall be periodically inspected and evaluated for: completeness; accuracy; consistency; timeliness; and reusability. For data with few fluctuations (information on martyrs, martyrs' cemeteries), reconciliation shall be conducted once every 06 months; for data that may fluctuate frequently (regimes, allowances), reconciliation shall be conducted within the time limit prescribed in legal documents in the field of people with meritorious services.

3. Dữ liệu được kiểm tra, đánh giá định kỳ về: tính đầy đủ; tính chính xác; tính thống nhất; tính kịp thời; khả năng sử dụng lại. Đối với các dữ liệu ít biến động (thông tin liệt sĩ, nghĩa trang liệt sĩ), việc đối soát được thực hiện định kỳ 06 tháng một lần; đối với dữ liệu có thể biến động thường xuyên (chế độ, trợ cấp), việc đối soát được thực hiện theo thời hạn quy định tại văn bản quy phạm pháp luật về lĩnh vực người có công.

4. Upon detecting discrepancies between data in the Database on people with meritorious services to the revolution and the National Population Database or relevant specialized databases, the database management agency shall preside over and coordinate the review, make a verification record, and adjust and update data according to its competence.

4. Khi phát hiện dữ liệu sai lệch giữa Cơ sở dữ liệu về người có công với cách mạng và Cơ sở dữ liệu quốc gia về dân cư hoặc cơ sở dữ liệu chuyên ngành có liên quan, cơ quan quản lý cơ sở dữ liệu chủ trì, phối hợp rà soát, lập biên bản xác minh và điều chỉnh, cập nhật dữ liệu theo thẩm quyền.

5. The database management agency shall organize the inspection, evaluation, and cleaning of data, and handling of duplicate data; for data no longer having use value according to law, organize the destruction according to safe procedures, ensuring complete erasure with no possibility of recovery in accordance with the law on archives, data, personal data protection, and relevant laws.

5. Cơ quan quản lý cơ sở dữ liệu tổ chức kiểm tra, đánh giá, làm sạch dữ liệu, xử lý dữ liệu trùng lặp; đối với dữ liệu không còn giá trị sử dụng theo quy định của pháp luật, tổ chức hủy bỏ theo quy trình an toàn, bảo đảm xóa bỏ hoàn toàn, không thể phục hồi theo quy định của pháp luật về lưu trữ, dữ liệu, bảo vệ dữ liệu cá nhân và pháp luật có liên quan.

Article 10. Data connection, sharing, and management of connection and sharing of the database on people with meritorious services to the revolution

Điều 10. Kết nối, chia sẻ dữ liệu và quản lý kết nối, chia sẻ dữ liệu cơ sở dữ liệu về người có công với cách mạng

1. The connection and sharing of data between the Database on people with meritorious services to the revolution and other databases of the Home Affairs sector shall be conducted via the Local Government Service Platform / Local Data Open Platform (LGSP/LDOP) of the Ministry of Home Affairs.

1. Việc kết nối, chia sẻ dữ liệu giữa Cơ sở dữ liệu về người có công với cách mạng với các cơ sở dữ liệu khác thuộc ngành Nội vụ được thực hiện thông qua Nền tảng tích hợp, chia sẻ, điều phối dữ liệu Bộ Nội vụ (LGSP/LDOP).

2. The connection and sharing of data on people with meritorious services to the revolution with information systems, national databases, and databases of ministries, sectors, and localities shall be conducted via the National Data Exchange Platform (NDXP) and the National Data Open Platform / sharing platform of the National Data Center (NDOP).

2. Việc kết nối, chia sẻ dữ liệu về người có công với cách mạng với các hệ thống thông tin, cơ sở dữ liệu quốc gia, cơ sở dữ liệu của Bộ, ngành, địa phương được thực hiện thông qua Nền tảng tích hợp, chia sẻ dữ liệu quốc gia (NDXP) và Nền tảng chia sẻ, điều phối dữ liệu của Trung tâm dữ liệu quốc gia (NDOP).

3. The method of data sharing shall be conducted via direct Application Programming Interfaces (APIs) or synchronization in accordance with unified technical connection guideline documents issued by the database management agency.

3. Phương thức chia sẻ dữ liệu được thực hiện thông qua giao diện lập trình ứng dụng (API) trực tiếp hoặc đồng bộ theo tài liệu hướng dẫn kỹ thuật kết nối thống nhất do cơ quan quản lý cơ sở dữ liệu ban hành.

4. Shared data must fall within the scope, purpose of use, method, time limit, and format as prescribed; ensuring completeness, accuracy, timeliness, safety, and security.

4. Dữ liệu được chia sẻ phải đúng phạm vi, mục đích sử dụng, phương thức, thời hạn và định dạng theo quy định; bảo đảm tính đầy đủ, chính xác, kịp thời, an toàn và bảo mật.

5. Master source data, master data, and reference data in Appendix 1, Appendix 2, and Appendix 3 issued together with this Circular must be inspected and evaluated before being connected and shared, and the synchronization of master data and reference data shall be conducted in real time.

5. Dữ liệu gốc, dữ liệu chủ, dữ liệu tham chiếu tại Phụ lục 1, Phụ lục 2, Phụ lục 3 ban hành kèm theo Thông tư này trước khi kết nối, chia sẻ phải được kiểm tra, đánh giá và việc đồng bộ dữ liệu chủ, dữ liệu tham chiếu được đồng bộ theo thời gian thực.

6. Activities regarding login management, electronic authentication, logging of connection logs, connection times, sharing activities, and necessary information serving inspection and tracing shall comply with the provisions of law on data, electronic transactions, information safety, cyber security, state secret protection, personal data protection, and regulations of the Ministry of Home Affairs.

Các hoạt động về quản lý đăng nhập, xác thực điện tử, ghi nhận nhật ký kết nối, thời điểm kết nối, hoạt động chia sẻ và các thông tin cần thiết phục vụ kiểm tra, truy vết tuân thủ quy định của pháp luật về dữ liệu, giao dịch điện tử, an toàn thông tin, an ninh mạng, bảo vệ bí mật nhà nước, bảo vệ dữ liệu cá nhân và quy định của Bộ Nội vụ.

Article 11. Exploitation and use of data from the database on people with meritorious services to the revolution

Điều 11. Khai thác và sử dụng từ dữ liệu cơ sở dữ liệu về người có công với cách mạng

1. Forms of data exploitation include: online exploitation on the system; exploitation through data connection and sharing; exploitation through data services; other forms as prescribed by law.

1. Hình thức khai thác dữ liệu gồm: khai thác trực tuyến trên hệ thống; khai thác thông qua kết nối, chia sẻ dữ liệu; khai thác thông qua dịch vụ dữ liệu; hình thức khác theo quy định của pháp luật.

2. Data exploitation rights shall be established according to functions, tasks, and scope of management; only necessary information fields appropriate to registered purposes may be exploited; data must not be used for other purposes or re-shared with third parties without permission. For personal data and sensitive data, exploitation must be strictly decentralized, with control mechanisms, and recording of exploitation history.

2. Quyền khai thác dữ liệu được xác lập theo chức năng, nhiệm vụ và phạm vi quản lý; chỉ được khai thác các trường thông tin cần thiết, phù hợp mục đích đã đăng ký; không sử dụng dữ liệu cho mục đích khác hoặc chia sẻ lại cho bên thứ ba khi chưa được phép. Đối với dữ liệu cá nhân, dữ liệu nhạy cảm, việc khai thác phải được phân quyền chặt chẽ, có cơ chế kiểm soát, ghi nhận lịch sử khai thác.

3. People with meritorious services, relatives of people with meritorious services, and beneficiaries of preferential policies for people with meritorious services are entitled to exploit and use their own information via electronic identification accounts on the National Identification Application (VNeID), and other methods as prescribed by law. The exploitation and use of data via the National Identification Application (VNeID) shall be conducted on the basis of data connection and sharing between the database on people with meritorious services to the revolution and the electronic identification and authentication system, ensuring full compliance with law.

3. Người có công, thân nhân người có công và người hưởng chính sách ưu đãi người có công được khai thác, sử dụng thông tin của mình thông qua tài khoản định danh điện tử trên Ứng dụng định danh quốc gia (VNeID), các phương thức khác theo quy định của pháp luật. Việc khai thác, sử dụng dữ liệu thông qua Ứng dụng định danh quốc gia (VNeID) được thực hiện trên cơ sở kết nối, chia sẻ dữ liệu giữa cơ sở dữ liệu về người có công với cách mạng với hệ thống định danh và xác thực điện tử, bảo đảm đúng quy định của pháp luật.

4. Data on people with meritorious services to the revolution shall be used to implement the state management of people with meritorious services in accordance with regulations.

4. Dữ liệu về người có công với cách mạng được sử dụng triển khai thực hiện quản lý nhà nước về người có công theo quy định.

Article 12. Storage of data in the database on people with meritorious services to the revolution

Điều 12. Lưu trữ dữ liệu cơ sở dữ liệu về người có công với cách mạng

1. Data on people with meritorious services to the revolution shall be stored at the Data Center of the Ministry of Home Affairs or the National Data Center in accordance with Circular No. 19/2026/TT-BNV; periodically backed up and ensured to be recoverable in the event of an incident.

1. Dữ liệu về người có công với cách mạng được lưu trữ tại Trung tâm dữ liệu Bộ Nội vụ hoặc Trung tâm dữ liệu quốc gia theo quy định của Thông tư số 19/2026/TT-BNV ; được sao lưu định kỳ và bảo đảm khả năng phục hồi khi có sự cố.

2. Data, records, and documents concerning martyrs and martyrs' graves shall ensure readiness for connection and submission to historical archives in accordance with the law on archives upon maturity.

2. Dữ liệu, hồ sơ, tài liệu về liệt sĩ, mộ liệt sĩ được bảo đảm khả năng sẵn sàng kết nối, nộp vào lưu trữ lịch sử theo quy định của pháp luật về lưu trữ khi đến hạn.

Article 13. Incident handling for the database on people with meritorious services to the revolution

Điều 13. Xử lý sự cố cơ sở dữ liệu về người có công với cách mạng

1. Upon detecting an incident affecting or threatening to affect the completeness, accuracy, integrity, availability, or security of the database on people with meritorious services to the revolution, agencies, organizations, and individuals must promptly notify the database management agency to take necessary measures to limit the scope and degree of impact.

1. Khi phát hiện sự cố ảnh hưởng hoặc có nguy cơ ảnh hưởng đến tính đầy đủ, chính xác, toàn vẹn, sẵn sàng, bảo mật của cơ sở dữ liệu về người có công với cách mạng, cơ quan, tổ chức, cá nhân phải kịp thời thông báo cho cơ quan quản lý cơ sở dữ liệu để thực hiện các biện pháp cần thiết hạn chế phạm vi, mức độ ảnh hưởng.

2. Based on the nature and severity of the incident, the agency managing and operating the database on people with meritorious services to the revolution shall preside over and coordinate with relevant agencies and units to determine the causes, scope, and degree of impact in order to organize the handling and remediation of the incident as prescribed.

2. Căn cứ tính chất, mức độ của sự cố, cơ quan quản lý, vận hành cơ sở dữ liệu về người có công với cách mạng chủ trì, phối hợp với cơ quan, đơn vị có liên quan xác định nguyên nhân, phạm vi, mức độ ảnh hưởng để tổ chức xử lý, khắc phục sự cố theo quy định.

Article 14. Implementation responsibilities

1. The Ministry of Home Affairs shall have the responsibility to:

a) Direct and organize the construction and management of the database on people with meritorious services to the revolution to serve state management and the implementation of preferential policies for people with meritorious services to the revolution, ensuring timeliness, accuracy, safety, and strict compliance with regulations. Regularly review and update detailed data fields of component databases of the database on people with meritorious services to the revolution, ensuring compliance with law.

a) Chỉ đạo, tổ chức xây dựng, quản lý cơ sở dữ liệu về người có công với cách mạng phục vụ quản lý nhà nước và thực hiện chính sách ưu đãi người có công với cách mạng bảo đảm kịp thời, chính xác, an toàn, đúng quy định. Thường xuyên rà soát, cập nhật các trường dữ liệu chi tiết của các cơ sở dữ liệu thành phần của cơ sở dữ liệu về người có công với cách mạng bảo đảm đúng quy định của pháp luật.

b) Direct the inspection, quality assessment, data reconciliation, and remediation of technical incidents arising during the creation, updating, exploitation, use, administration, and operation of the database on people with meritorious services to the revolution.

b) Chỉ đạo kiểm tra, đánh giá chất lượng, đối soát dữ liệu và khắc phục các sự cố kỹ thuật phát sinh trong quá trình tạo lập, cập nhật, khai thác, sử dụng và quản trị, vận hành cơ sở dữ liệu về người có công với cách mạng.

c) Coordinate with the Ministry of Public Security to connect the National Population Database and the electronic identification and authentication system with the database on people with meritorious services to the revolution to serve citizen information authentication and reconciliation, data reuse, and provision of utilities to citizens via VNeID in accordance with law.

c) Phối hợp với Bộ Công an kết nối Cơ sở dữ liệu quốc gia về dân cư, hệ thống định danh và xác thực điện tử với cơ sở dữ liệu về người có công với cách mạng để phục vụ xác thực, đối soát thông tin công dân, tái sử dụng dữ liệu và cung cấp các tiện ích cho người dân thông qua VNeID theo quy định của pháp luật.

d) Preside over, urge, and guide relevant units in the creation of data and the management and use of the database on people with meritorious services to the revolution.

d) Chủ trì, đôn đốc, hướng dẫn các đơn vị liên quan trong việc tạo lập dữ liệu và quản lý, sử dụng cơ sở dữ liệu về người có công với cách mạng.

dd) Announce and provide open data on people with meritorious services to the revolution for agencies, organizations, and individuals to access, use, reuse, and share according to announced conditions of use, except for personal data, sensitive data, state secret data, and other data not permitted to be made public as prescribed by law.

đ) Thực hiện công bố, cung cấp dữ liệu mở về người có công với cách mạng để các cơ quan, tổ chức, cá nhân tiếp cận, sử dụng, tái sử dụng, chia sẻ theo điều kiện sử dụng được công bố, trừ dữ liệu cá nhân, dữ liệu nhạy cảm, dữ liệu thuộc bí mật nhà nước và dữ liệu khác không được phép công khai theo quy định của pháp luật.

2. The Department of People with Meritorious Services shall advise and assist the Minister of Home Affairs within the scope of assigned functions, tasks, and powers to perform the management of the database on people with meritorious services to the revolution, carrying out the administration, operation, updating, connection, sharing, exploitation, and use of the database.

2. Cục Người có công tham mưu, giúp Bộ trưởng Bộ Nội vụ trong phạm vi chức năng, nhiệm vụ và quyền hạn được giao, thực hiện quản lý cơ sở dữ liệu về người có công với cách mạng, thực hiện quản trị, vận hành, cập nhật, kết nối, chia sẻ, khai thác và sử dụng cơ sở dữ liệu.

3. Relevant agencies, organizations, and units, within the scope of their assigned functions, tasks, and powers, shall have the responsibility to:

3. Các cơ quan, tổ chức, đơn vị có liên quan trong phạm vi chức năng, nhiệm vụ, quyền hạn được giao có trách nhiệm:

a) Perform digitization, creation, updating, standardization, and management of data under their management scope in accordance with the law on preferential treatment of people with meritorious services to the revolution and relevant laws; ensure that data are complete, accurate, timely, and consistent, and take responsibility for the content of data provided;

a) Thực hiện số hóa, tạo lập, cập nhật, chuẩn hóa, quản lý dữ liệu thuộc phạm vi quản lý theo quy định của pháp luật ưu đãi người có công với cách mạng và pháp luật có liên quan; bảo đảm dữ liệu đầy đủ, chính xác, kịp thời, thống nhất và chịu trách nhiệm về nội dung dữ liệu cung cấp;

b) Implement data connection and sharing as prescribed.

Article 15. Effect and implementation organization

Điều 15. Hiệu lực và tổ chức thi hành

a) This Circular takes effect from November 29, 2026.

b) In case legal documents referred to in this Circular are amended, supplemented, or replaced, the amending, supplementing, or replacing documents shall apply.

b) During the course of implementation, if difficulties or problems arise, agencies, units, organizations, and individuals should report them to the Ministry of Home Affairs for guidance or study, amendment, and supplementation./.
