Following the first-instance trial, the First-Instance Civil Judgment No. 48/2026/DS-ST dated January 16, 2026 of the People’s Court of Area 3, Hanoi City was appealed as follows:

Sau khi xét xử sơ thẩm, Bản án dân sự sơ thẩm số 48/2026/DS-ST ngày 16/01/2026 của Tòa án nhân dân khu vực 3, Thành phố Hà Nội bị kháng cáo như sau:

Mr. ⟨P1⟩ – the defendant, and Mrs. ⟨D1⟩ - person with related rights and obligations in the case appealed against the entire first-instance judgment No. 48/2026/DS-ST dated January 16, 2026 of the People’s Court of Area 3, Hanoi City.

Ông ⟨P1⟩ – là bị đơn và Bà ⟨D1⟩ - là người có quyền lợi và nghĩa vụ liên quan trong vụ án kháng cáo toàn bộ bản án sơ thẩm số 48/2026/DS-ST ngày 16/01/2026 của Tòa án nhân dân khu vực 3, Thành phố Hà Nội.

CONSIDERING THAT:

XÉT THẤY:

At today's appellate court session, Mr. ⟨P1⟩ – the defendant, and Mrs. ⟨D1⟩ - person with related rights and obligations and concurrently appellants, filed applications for adjournment of the court session due to personal business requiring direct resolution that prevented them from arranging time to attend the court session. This is the second time the appellants were duly summoned by the Court but were absent from the court session, and their absence was not due to an event of force majeure. Under the provisions of Clause 3, Article 296 of the Civil Procedure Code, in the case where: Mr. T and Mrs. H are absent from the court session for the second time as stated above, they are deemed to have abandoned their appeal and the Appellate Trial Panel issues a decision to suspend the appellate trial of the case.

Tại phiên tòa phúc thẩm hôm nay, Ông ⟨P1⟩ – là bị đơn và Bà ⟨D1⟩ - là người có quyền lợi và nghĩa vụ liên quan đồng thời là người kháng cáo có đơn xin hoãn phiên toà do có công việc cần trực tiếp giải quyết không thể sắp xếp thời gian đến phiên toà. Đây là lần thứ hai người có kháng cáo được Tòa án triệu tập hợp lệ mà vắng mặt tại phiên tòa, việc vắng mặt của người có kháng cáo không vì sự kiện bất khả kháng. Theo quy định tại khoản 3 Điều 296 Bộ luật tố tụng dân sự thì trường hợp: Ông T và Bà H vắng mặt tại phiên tòa lần thứ hai như trên bị coi là từ bỏ việc kháng cáo và Hội đồng xét xử phúc thẩm ra quyết định đình chỉ xét xử phúc thẩm vụ án.

The People's Procuracy of Hanoi City recommended that the Trial Panel issue a decision to suspend the appellate trial of the case docketed under No. 483/2026/TLPT-DS dated July 27, 2026 of the People’s Court of Hanoi City.

Viện Kiểm sát nhân dân thành phố Hà Nội đề nghị HĐXX ra quyết định đình chỉ xét xử phúc thẩm vụ án thụ lý số 483/2026/TLPT-DS ngày 27/07/2026 của Toà án nhân dân Thành phố Hà Nội.

Regarding appellate civil court fees: The appellants must bear the appellate civil court fees in accordance with regulations.

Về án phí dân sự phúc thẩm: Người kháng cáo phải chịu án phí dân sự phúc thẩm theo quy định.

Pursuant to Article 295; Article 296; Article 312 of the Civil Procedure Code 2015.

DECIDES:

QUYẾT ĐỊNH:

I. To suspend the appellate trial of the civil case docketed under No. 483/2026/TLPT-DS regarding “Dispute over property loan contract” between the litigants:

I. Đình chỉ xét xử phúc thẩm vụ án dân sự thụ lý số 483/2026/TLPT-DS về việc “Tranh chấp hợp đồng vay tài sản” giữa các đương sự:

1. Plaintiff: Mr. ⟨T1⟩, born in: 1975; Citizen Identity Card No. 024075018438 issued by the Police Department for Administrative Management of Social Order on July 10, 2021; Permanent address: Group D, Ward T, District Đ, Hanoi City.

II. The First-Instance Civil Judgment No. 48/2026/DS-ST dated January 16, 2026 of the People’s Court of Area 3, Hanoi City takes legal effect from the date of issuance of this decision.

II. Bản án dân sự sơ thẩm số 48/2026/DS-ST ngày 16/01/2026 của Tòa án nhân dân khu vực 3, Thành phố Hà Nội có hiệu lực pháp luật kể từ ngày ban hành quyết định này.

III. Regarding appellate civil court fees: Mr. ⟨P1⟩ and Mrs. ⟨D1⟩ each must bear 300,000 VND in appellate civil court fees, which shall be deducted from the paid court fee advance amount of 300,000 VND according to the court fee advance receipts No. 0006063 and 0006065 dated March 16, 2026 at the Civil Judgment Enforcement of Hanoi City.

III. Về án phí dân sự phúc thẩm: Ông ⟨P1⟩ và Bà ⟨D1⟩ mỗi người phải chịu 300.000 đồng án phí dân sự phúc thẩm, được trừ vào số tiền 300.000 đồng tạm ứng án phí đã nộp theo biên lai thu tạm ứng án phí số 0006063 và 0006065 ngày 16 tháng 3 năm 2026 tại Thi hành án dân sự thành phố Hà Nội.

IV. The decision to suspend the appellate trial of the case takes effect for enforcement.

IV. Quyết định đình chỉ xét xử phúc thẩm vụ án có hiệu lực thi hành án.
