Pursuant to the Government's Decree No. 362/2025/ND-CP detailing a number of articles and measures for organizing and guiding the implementation of the Law on Fees and Charges;

Căn cứ Nghị định số 362/2025/NĐ-CP của Chính phủ quy định chi tiết một số điều và biện pháp để tổ chức, hướng dẫn thi hành Luật Phí và lệ phí;

Pursuant to the Government's Decree No. 347/2025/ND-CP regulating administrative procedures in the field of the State Treasury;

Căn cứ Nghị định số 347/2025/NĐ-CP của Chính phủ quy định về thủ tục hành chính thuộc lĩnh vực Kho bạc Nhà nước;

Pursuant to the Government's Decree No. 252/2026/ND-CP detailing a number of articles and measures for organizing and guiding the implementation of the Law on Tax Administration;

Căn cứ Nghị định số 252/2026/NĐ-CP của Chính phủ quy định chi tiết một số điều và biện pháp để tổ chức, hướng dẫn thi hành Luật Quản lý thuế;

Pursuant to the Government's Decree No. 332/2026/ND-CP regulating business activities of cybersecurity products and services;

Căn cứ Nghị định số 332/2026/NĐ-CP của Chính phủ quy định về hoạt động kinh doanh sản phẩm, dịch vụ an ninh mạng;

Pursuant to the Government's Decree No. 376/2026/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Căn cứ Nghị định số 376/2026/NĐ-CP của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài chính;

At the proposal of the Director General of the Department of Tax, Fee and Charge Policy;

Theo đề nghị của Vụ trưởng Vụ Chính sách thuế, phí và lệ phí;

The Minister of Finance hereby promulgates the Circular prescribing the rates, collection and payment regimes of fees and charges in the cybersecurity sector.

Bộ trưởng Bộ Tài chính ban hành Thông tư quy định mức thu, chế độ thu, nộp phí và lệ phí thuộc lĩnh vực an ninh mạng.

Article 1. Scope of regulation and subjects of application

Điều 1. Phạm vi điều chỉnh, đối tượng áp dụng

1. This Circular prescribes the rates, collection and payment regimes of fees and charges in the cybersecurity sector, including: fee for appraisal for the grant of a business license for cybersecurity products and services; fee for appraisal and certification of cybersecurity standard conformity and technical regulation conformity; charge for the grant of an import license for cybersecurity products; charge for the grant of sender identifiers used in online advertising activities (charge for the grant of a certificate of sender identifier used in online advertising activities).

1. Thông tư này quy định mức thu, chế độ thu, nộp phí và lệ phí thuộc lĩnh vực an ninh mạng, bao gồm: phí thẩm định cấp giấy phép kinh doanh sản phẩm, dịch vụ an ninh mạng; phí thẩm định và chứng nhận hợp chuẩn, hợp quy về an ninh mạng; lệ phí cấp giấy phép nhập khẩu sản phẩm an ninh mạng; lệ phí cấp tên định danh người gửi dùng trong hoạt động quảng cáo trên mạng (lệ phí cấp giấy chứng nhận tên định danh người gửi dùng trong hoạt động quảng cáo trên mạng).

2. This Circular applies to fee and charge payers, fee and charge collecting organizations, and other organizations and individuals related to the collection and payment of fees and charges in the cybersecurity sector.

2. Thông tư này áp dụng đối với người nộp phí, lệ phí, tổ chức thu phí, lệ phí và tổ chức, cá nhân khác có liên quan đến thu, nộp phí và lệ phí thuộc lĩnh vực an ninh mạng.

Article 2. Payers of fees and charges

Điều 2. Người nộp phí và lệ phí

1. Organizations and individuals, when submitting dossiers requesting the appraisal for the grant of a business license for cybersecurity products and services; appraisal and certification of cybersecurity standard conformity and technical regulation conformity; grant of an import license for cybersecurity products, shall pay fees and charges in accordance with this Circular;

1. Tổ chức, cá nhân khi nộp hồ sơ đề nghị thẩm định cấp giấy phép kinh doanh sản phẩm, dịch vụ an ninh mạng; thẩm định và chứng nhận hợp chuẩn, hợp quy về an ninh mạng; cấp giấy phép nhập khẩu sản phẩm an ninh mạng phải nộp phí và lệ phí theo quy định tại Thông tư này;

2. Organizations and individuals granted a certificate of sender identifier used in online advertising activities shall pay charges in accordance with this Circular.

2. Tổ chức, cá nhân được cấp giấy chứng nhận tên định danh người gửi dùng trong hoạt động quảng cáo trên mạng phải nộp lệ phí theo quy định tại Thông tư này.

Article 3. Fee and charge collecting organizations

Điều 3. Tổ chức thu phí và lệ phí

Competent state agencies responsible for appraisal for the grant of a business license for cybersecurity products and services; appraisal and certification of cybersecurity standard conformity and technical regulation conformity; grant of an import license for cybersecurity products; grant of a certificate of sender identifier used in online advertising activities shall be the fee and charge collecting organizations under this Circular.

Cơ quan nhà nước có thẩm quyền thẩm định cấp giấy phép kinh doanh sản phẩm, dịch vụ an ninh mạng; thẩm định và chứng nhận hợp chuẩn, hợp quy về an ninh mạng; cấp giấy phép nhập khẩu sản phẩm an ninh mạng; cấp giấy chứng nhận tên định danh người gửi dùng trong hoạt động quảng cáo trên mạng là tổ chức thu phí và lệ phí theo quy định tại Thông tư này.

Article 4. Fee and charge rates

Điều 4. Mức thu phí và lệ phí

The fee and charge rates are specified in the Schedule of Fee and Charge Rates in the Cybersecurity Sector issued together with this Circular.

Mức thu phí và lệ phí được quy định tại Biểu mức thu phí và lệ phí thuộc lĩnh vực an ninh mạng ban hành kèm theo Thông tư này.

Article 5. Declaration, payment of fees and charges, and fee finalization

Điều 5. Khai, nộp phí, lệ phí và quyết toán phí

1. Payers of fees and charges shall pay fee and charge amounts into the state budget in the forms specified in Clause 1, Article 3 of Decree No. 362/2025/ND-CP detailing a number of articles and measures for organizing and guiding the implementation of the Law on Fees and Charges.

1. Người nộp phí, lệ phí nộp tiền phí, lệ phí vào ngân sách nhà nước theo hình thức quy định tại khoản 1 Điều 3 Nghị định số 362/2025/NĐ-CP quy định chi tiết một số điều và biện pháp để tổ chức, hướng dẫn thi hành Luật Phí và lệ phí.

2. Fee and charge collecting organizations shall remit 100% of the collected fee and charge amounts into the state budget according to the chapters and sub-items of the current State Budget Index, including accrued interest (if any) on the balance of the relevant account during the collection of fees and charges. Expenses for covering activities of providing services and collecting fees and charges shall be allocated by the state budget in the estimates of the fee and charge collecting organizations according to the regimes and state budget expenditure norms prescribed by law. Fee and charge collecting organizations shall declare and pay fees and charges, and finalize fees in accordance with Clause 3, Article 3 of Decree No. 362/2025/ND-CP.

2. Tổ chức thu phí, lệ phí nộp 100% số tiền phí, lệ phí thu được vào ngân sách nhà nước theo chương, tiểu mục của Mục lục ngân sách nhà nước hiện hành, bao gồm tiền lãi phát sinh (nếu có) trên số dư tài khoản liên quan trong quá trình thu phí, lệ phí. Nguồn chi phí trang trải cho hoạt động cung cấp dịch vụ, thu phí, lệ phí được ngân sách nhà nước bố trí trong dự toán của tổ chức thu phí, lệ phí theo chế độ, định mức chi ngân sách nhà nước theo quy định của pháp luật. Tổ chức thu phí, lệ phí khai, nộp phí, lệ phí và quyết toán phí theo quy định tại khoản 3 Điều 3 Nghị định số 362/2025/NĐ-CP .

Article 6. Implementation organization

Điều 6. Tổ chức thực hiện

1. This Circular takes effect from October 09, 2026.

1. Thông tư này có hiệu lực thi hành từ ngày 09 tháng 10 năm 2026.

2. Circular No. 269/2016/TT-BTC prescribing the rates, collection, payment, management and use regimes of fees and charges in the information security sector ceases to be effective from the effective date of this Circular.

2. Thông tư số 269/2016/TT-BTC quy định mức thu, chế độ thu, nộp, quản lý và sử dụng phí và lệ phí thuộc lĩnh vực an toàn thông tin hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực thi hành.

3. For dossiers requesting appraisal for the grant of a business license for cybersecurity products and services; appraisal and certification of cybersecurity standard conformity and technical regulation conformity; grant of an import license for cybersecurity products; grant of a certificate of sender identifier used in online advertising activities submitted to competent state agencies before the effective date of this Circular for which fees and charges have not yet been paid, the fee and charge collecting organizations shall collect fees and charges in accordance with this Circular.

3. Đối với hồ sơ đề nghị thẩm định cấp giấy phép kinh doanh sản phẩm, dịch vụ an ninh mạng; thẩm định và chứng nhận hợp chuẩn, hợp quy về an ninh mạng; cấp giấy phép nhập khẩu sản phẩm an ninh mạng; cấp giấy chứng nhận tên định danh người gửi dùng trong hoạt động quảng cáo trên mạng nộp cho cơ quan nhà nước có thẩm quyền trước ngày Thông tư này có hiệu lực nhưng chưa nộp phí, lệ phí thì tổ chức thu phí, lệ phí thực hiện thu phí, lệ phí theo quy định tại Thông tư này.

4. Other contents regarding declaration, collection, payment, and public disclosure of fee and charge collection regimes not prescribed in this Circular shall comply with the provisions of: the Law on Fees and Charges No. 97/2015/QH13; the Law on Tax Administration No. 108/2025/QH15 and Decree No. 252/2026/ND-CP detailing a number of articles and measures for organizing and guiding the implementation of the Law on Tax Administration; Decree No. 362/2025/ND-CP; Decree No. 347/2025/ND-CP regulating administrative procedures in the field of the State Treasury.

4. Các nội dung khác liên quan đến việc khai, thu, nộp, công khai chế độ thu phí, lệ phí không quy định tại Thông tư này được thực hiện theo quy định tại các văn bản: Luật Phí và lệ phí số 97/2015/QH13 ; Luật Quản lý thuế số 108/2025/QH15 và Nghị định số 252/2026/NĐ-CP quy định chi tiết một số điều và biện pháp để tổ chức, hướng dẫn thi hành Luật Quản lý thuế; Nghị định số 362/2025/NĐ-CP ; Nghị định số 347/2025/NĐ-CP quy định về thủ tục hành chính thuộc lĩnh vực Kho bạc Nhà nước.

5. In case the documents cited in this Circular are amended, supplemented or replaced, the amending, supplementing or replacing documents shall prevail.

5. Trường hợp các văn bản viện dẫn tại Thông tư này được sửa đổi, bổ sung hoặc thay thế thì thực hiện theo văn bản sửa đổi, bổ sung hoặc thay thế đó.

6. In the course of implementation, if any difficulties arise, organizations and individuals are requested to promptly report them to the Ministry of Finance for study and additional guidance./.

6. Trong quá trình thực hiện, trường hợp có vướng mắc, đề nghị các tổ chức, cá nhân phản ánh kịp thời về Bộ Tài chính để nghiên cứu, hướng dẫn bổ sung./.
