DECISION TO TERMINATE RESOLUTION OF MARRIAGE AND FAMILY CASE

QUYẾT ĐỊNHĐÌNH CHỈ GIẢI QUYẾT VỤ ÁN HÔN NHÂN VÀ GIA ĐÌNH

Pursuant to Articles 48, 217, 218, 219 and Clause 2, Article 273 of the Civil Procedure Code;

Căn cứ vào các Điều 48, 217, 218, 219 và khoản 2 Điều 273 của Bộ luật Tố tụng dân sự;

After studying the case files of the first-instance marriage and family case accepted under No. 695/2026/TLST-HNGĐ dated September 03, 2026;

Sau khi nghiên cứu hồ sơ vụ án hôn nhân và gia đình sơ thẩm thụ lý số 695/2026/TLST-HNGĐ ngày 03 tháng 9 năm 2026;

Considering that: The petitioner withdrew the entire petition pursuant to Point c, Clause 1, Article 217 of the Civil Procedure Code;

Xét thấy: Người khởi kiện rút toàn bộ yêu cầu khởi kiện theo quy định tại điểm c khoản 1 Điều 217 của Bộ luật Tố tụng dân sự;

DECIDES:

QUYẾT ĐỊNH:

1. To terminate the resolution of the first-instance marriage and family case accepted under No. 695/2026/TLST-HNGĐ dated September 03, 2026 regarding the "marriage and family dispute over divorce, dispute over child custody", between:

1. Đình chỉ giải quyết vụ án hôn nhân và gia đình sơ thẩm thụ lý số 695/2026/TLST-HNGĐ ngày 03 tháng 9 năm 2026 về việc “tranh chấp hôn nhân và gia đình ly hôn, tranh chấp về nuôi con”, giữa:

Petitioner: Mr. ⟨N1⟩, born in 1991; address: Group F, Hamlet A, Commune A, An Giang Province.

Nguyên đơn: Ông ⟨N1⟩, sinh năm 1991; địa chỉ: tổ F, ấp A, xã A, tỉnh An Giang.

Respondent: Mrs. ⟨L1⟩, born in 1996; address: Group A, Hamlet V, Commune A, An Giang Province.

Bị đơn: Bà ⟨L1⟩, sinh năm 1996; địa chỉ: tổ A, ấp V, xã A, tỉnh An Giang.

2. Hậu quả của việc đình chỉ giải quyết vụ án:

Mr. ⟨N1⟩ has the right to file a lawsuit requesting the competent People's Court to re-resolve the marriage and family case pursuant to the provisions of the civil procedure law.

Ông ⟨N1⟩ có quyền khởi kiện yêu cầu Tòa án nhân dân có thẩm quyền giải quyết lại vụ án hôn nhân và gia đình theo quy định của pháp luật tố tụng dân sự.

To refund to Mr. ⟨N1⟩ the court fee advance amount of 300,000 (three hundred thousand) VND according to the receipt for advance payment of court fees and charges No. 0002758 dated August 26, 2026 of the Civil Judgment Enforcement of An Giang Province.

Hoàn trả cho ông ⟨N1⟩ số tiền tạm ứng án phí 300.000 (ba trăm nghìn) đồng theo biên lai thu tạm ứng án phí, lệ phí Tòa án số 0002758 ngày 26 tháng 8 năm 2026 của Thi hành án dân sự tỉnh An Giang.

3. The parties have the right to appeal, and the Procuracy of the same level has the right to protest this decision within 07 days from the date of receipt of the decision or from the date the decision is publicly posted in accordance with the provisions of the Civil Procedure Code.

3. Các đương sự có quyền kháng cáo, Viện kiểm sát cùng cấp có quyền kháng nghị quyết định này trong thời hạn 07 ngày kể từ ngày nhận được quyết định hoặc kể từ ngày quyết định được niêm yết theo quy định của Bộ luật tố tụng dân sự.
